`The above—captioned Trademark Trial and Appeal Board cases are presently
`
`suspended pending the disposition of the civil action entitled Dean Rhoades and
`
`DermaNew, Inc. v. Avon Products, Inc. and Does 1 through 10, inclusive, filed in the
`
`United States District Court for the Central District of California, Western District, Civil
`
`Case No. 05—02169R (MANX) (the "Civil Action"). This will update the Trademark
`
`Trial and Appeal Board on the status of the Civil Action. Avon Products, Inc., the
`
`Opposer and Petitioner in the above—identified Trademark Trial and Appeal Board
`
`proceedings, filed a Motion to Dismiss the Civil Action. On June 13, 2005, U.S. District
`
`Court Judge Manuel Real held an oral hearing and granted the Motion to Dismiss.
`
`Attached hereto is a copy of the Court's order dated June 13, 2005. Counsel
`
`for Dean L. Rhoades will advise the Board upon the expiration of his time to appeal the
`
`ruling on the Motion to Dismiss, whether or not he will be appealing the ruling. Dean L.
`
`Rhoades requests that the Trademark Trial and Appeal Board proceedings remain
`
`
`
`suspended until the Civil Action has been finally determined, i.e. there has been a
`
`dispositive ruling that ends litigation on the merits and no appeal has been filed
`
`therefrom, or all appeals filed have been decided, pursuant to T.B.M.P. Section
`
`5 l0.02(b).
