`Opposer in the above-identified opposition proceeding, pursuant to Section

`2.117(a) of the Trademark Rules of Practice (37 C.F.R. §2.117(a)), hereby moves to

`suspend all proceedings in this Opposition pending the outcome of federal litigation

`involving the parties in connection with the mark at issue in this Opposition.

`In support of such motion, Opposer states as follows:

`On July 23, 2004, Applicant filed a complaint in the United States District

`Court for the Central District of California entitled City Glatt, Inc. vs. Lishi Trading
`
`Limited, Lishi Trading Inc., Shimshon Welner, Liora Welner and DOES 1 through 10,

`Case No. CV04-6037 (the “Federal Litigation”). A true and correct copy of the
`
`complaint is attached hereto as Exhibit A.

`On November 16, 2004, Opposer filed a counter-claim in the Federal

`Litigation seeking, among other things, injunctive relief and damages arising out of
`
`Opposer’s use of and attempt to register the trademark which is the subject matter of this
`
`Opposition. A true and correct copy of the counter-claim (excluding the exhibits thereto)
`
`is attached hereto as Exhibit B.
`

`Because the issues involved in the pending federal civil action will be
`
`dispositive of this Opposition, Opposer believes that it would be in the interest of the
`
`parties and in the interests.ofjustice and would avoid a multiplicity of litigation, the
`
`possibility of inconsistent rulings on the same issues, and undue expense and burden, to
`
`suspend this Opposition pending the outcome of the Federal Litigation. As such,
`
`Opposer hereby moves that these proceedings be suspended pursuant to Section 2.117(a)
`
`of the Trademark Rules of Practice.
