`Since September 2004, Daucourt Martin Imports, LLC (hereinafier, “DMI) has

`been the exclusive marketer and United States importer of spirits and related products, such as
`
`clothing, sold under
`
`its trademarks X, X-RATED, and X-RATED FUSION LIQUEUR,
`
`including both vodka and fruit—flavored liqueur (the “Trademarks”).
`

`The packaging for DMI’s fruit-flavored liqueur includes distinct elements that
