`principai place of business at 1440 Broadway New York, New York 10018, believes that it Wili

`be damaged if a registration is granted on the abovencaptioned trademark appiication of Mr. Joe
`
`Gomez, having an address of record of 10521 W. Berkeley Road, Avondale, Arizona 85323,

`and correspondent of record of Michael A. Cordier, Deconcini McDonaid Yetwin & Lacy,
`
`P.C., 7310 N. 16th Street, Suite 330, Phoenix, AZ 85020-5276, and hereby opposes such
`
`registration.

`As grounds for its opposition, Opposer alleges that:

`Among other US. trademark registrations, Opposer is the owner of a valid and

`subsisting U.S. Trademark Registration No. 1,382,406, for the niark CACHE for Ladies’
`
`clothing, namely, shirts, tops, pants, jackets, suits, dresses, belts, shoes, scarves, skirts, skirts
`
`with coordinating tops, Tmshirts and coats, and U.S. Trademark Registration No. 1,351,848 for
`the mark CACHE (stylized) for Ladies’ clothing, namely, shirts,
`tops, pants, jackets, suits,
`
`dresses, belts, shoes, scarves, skirts, skirts with coordinates, T-shirts and coats,‘ Retail clothing
`
`store services. Copies of these registrations are attached hereto.

`Trademark Application No. 77/285,711 for CACHE, and US. Trademark Application No.

`77/285,763 for CACHE (stylized), for Jewelry and Purses, clutch purses, handbags, and

`Satchels, copies of which are attached hereto.

`On March 9, 2007, Applicant filed, under Trademark Act § 105l(b), U.S.
`
`Trademark Application No. 77/ 127,396 based on an intent—to-use the mark in commerce, for
`
`federal registration of the mark MODE D’CACHE & DESIGN for use with Purses and
`
`handbags and Women ’s clothing, namely, dresses, suits, pants, sweaters, shirts, blouses, shorts
`
`and leggings, footwear, headwear, clothing accessories, namehi, scarves, belts, wraps and
`
`gloves, a copy of which is attached hereto.

`Upon information and belief, Applicant has not used the mark MODE
`
`UCACHE & DESIGN in US. Commerce.
`

`Opposer has used, in U.S. commerce, the marks CACHE and CACHE (stylized)
`
`(as shown in 0pposer’s U.S. Trademark Registration No. 1,351,848) with a wide-range of
`
`wornenfs clothing and accessories, including jewelry, long prior to any date Applicant can rely
`
`on for use of the mark MODE D’CACI-IE & DESIGN shown in Applicanfs U.S. Trademark
`
`Application No. 77/ 127,396.

`Opposer has spent significant amounts of revenue and resources in the
`
`marketing and sale of goods and services bearing the CACHE, CACHE (stylized), and CACHE
`
`LUXE marks, and through these efforts has established vaiuable consumer recognition and
`
`goodwill in and to these marks.
`

`Applicant’s registration of the mark MODE ITCACHE & DESIGN, as shown in
`
`the herein opposed U.S. Trademark Application No. 77/ 127,396 will create a likelihood of
`
`confusion, mistake and/or deception amongst consumers within the meaning of U.S. Trademark
`
`Act Section 2(d), 15 U.S.C. 1052(d), all to the detrirr1entofOpposer.

`App1icant’s registration of the mark MODE ITCACHE & DESIGN, as shown in

`the herein opposed U.S. Trademark Application No. 77/ 127,396 will create a likelihood of
