`On August 22, 2006, Applicant filed Application Serial No. 78/957,779 to

`register the mark FastEMC in International Class 9 for the following goods: "Computer e-

`commerce software to allow users to perform electronic business transactions via a global

`computer network; Computer sofiware platforms for medical billing."

`Upon information and belief, neither Applicant nor any predecessor or
`
`related company of Applicant has any basis for claiming rights in FastIEMC 1'n'connection with
`
`the identified goods prior to Opposer's first use of its EMC Marks.

`Applicant’s use of and application to register the mark FastEMC is
`
`without Opposer’s consent.
`

`Applicant’s use of FastBMC is likely to cause confislsion, mistal<e or
`
`deception with Opposer and its EMC Marks, individually and collectively, and is likely to cause
`
`purchasers and others erroneously to believe that Applicant or its FastEMC goods are in some
`
`way legitimately connected with, sponsored, licensed or approved by," Opposer.

`WHBREFORE, registration by Applicant of FastEMC for the goods stated in_ 7

`Application Serial No. 78/957,779 would be damaging to Opposer.
