`In the matter of U.S. Trademark Application Serial No. 77/238,217 for the mark CHAU

`DOC (“Applicant’s Mark”) filed on July 25, 2007 in accordance with Section 1(a) ofthe Trademark
`
`Act by Chau Doc, Inc., a California corporation with an address at 11450 Lampson Avenue, Apt.
`
`#211, Garden Grove, California 92840 (“Applicant”), and published in the Official Gazette on
`
`January 29, 2008, Anhing Corporation, a California corporation with a business address at 418 North
`
`Avenue 19, Los Angeles, California 90031 (“Opposer”) believes that it would be damaged by the
`
`registration sought in Application Serial No. 77/238,217, and hereby opposes the registration of
`
`Applicant’s Mark.
`
`As grounds for the opposition, Opposer avers:
`
`1.
`
`At least as early as March 9, 1984, Opposer commenced use in U.S. commerce of its
`
`mark CHAUDOC (“Opposer’s Mark”) for use with coconut milk (International Class 29), which use
`

`has grown to include coconut juice beginning in February l989 (International Class 32) and coconut
`
`powder beginning in March 1994 (International Class 30).
`

`
`Opposer is the owner of all rights, title and interest in and to Opposer’s Mark for a
`
`variety of goods, and is the owner of U.S. Registration Nos. l,583,809 (now incontestable) and
`
`2,764,319 for Opposer’s Mark, which registrations are valid and subsisting and provide primafacie
`
`evidence of Opposer’s ownership of Opposer’s Mark and of its exclusive right to use Opposer’s
`
`Mark in U.S. commerce.
`

`By virtue of Opposer’s use of Opposer’s Mark, the public has come to associate the
`
`mark with Opposer’s goods, and as a result, Opposer has developed a valuable reputation in
`
`connection with Opposer’s Mark. Further, Opposer has expended considerable time, effort, and
`
`money in advertising and otherwise promoting its products and encouraging the public and trade to
`
`recognize Opposer’s Mark such that Opposer has acquired extensive goodwill and common law
`
`trademark rights in Opposer’s Mark.
`

`On or about July 25, 2007, Applicant filed Application Serial No. 77/238,217 for
`
`App1icant’s Mark covering
`
`bean-starch noodles; Chinese noodles; Chinese rice noodles; chow mein noodles;
`
`instant Chinese noodles; instant noodles; instant soba noodles; instant udon noodles;
`
`mix for making combined noodle and sauce dish; noodles; noodles and sauce mixes
`
`combined in unitary packages; noodles and seasoning mixes combined in unitary
`
`packages; noodles, sauce, and processed vegetables combined in unitary packages;
`
`noodles, sauce, and seasoning toppings combined in unitary packages; noodles,
`
`sauce, and topping combined in unitary packages; noodles, sauce, dehydrated
`
`vegetables, and topping combined in unitary packages; noodles, seasonings, edible
`

`oil, and dehydrated vegetables combined in unitary packages; noodles, seasonings,
`
`edible oil, and flavorings combined in unitary packages; rice noodles; soba noodles;
`
`somen noodles; and udon noodles
`
`in International Class 30, alleging first use as of an unspecified date in 1981, based on Section 1(a) of
`
`the Lanham Act (the “‘2 17 Application”). The ‘2 l 7 Application published for opposition on January
`
`29, 2008.
`
`Count I — Fraud
`
`5.
`
`Upon information and belief, Applicant operated a Vietnamese restaurant located at
`
`9358 Westminster Boulevard, Westminster, California 92683, that provided restaurant services
`
`under the trade name BANH HOI CHAU DOC (printouts ofVarious online directory listings for the
`
`restaurant are attached as Exhibit A), which is confirmed by the restaurant flyer “use specimen”
`
`Applicant submitted in support of the ‘Z17 Application. The two noodles goods-related use
`
`specimens Applicant submitted in support of the ‘2l7 Application clearly reflect that Applicant’s
`
`Mark,
`
`in fact, has not been used as Applicant’s trademark for the goods listed in the ‘2l7
`
`Application, but only as part of the CHAU DOC INC. enterprise name of the Applicant.
`

`
`Upon information and belief, at the time of filing the ‘2l7 Application, Applicant’s
`
`alleged use of Applicant’s Mark was not in interstate or international commerce, but merely
`
`intrastate commerce insufficient to qualify for federal registration.
`
`7.
`
`Upon information and belief, Applicant’s claims at the time of filing the ‘2l7
`
`Application that (a) Applicant uses Applicant’s Mark on or in connection with every item of goods
`
`specified in the application and (b) that such use began in 1981 and continued to the filing date ofthe
`
`‘Z17 Application for every item of goods specified in the application, constitute material, false
`
`representations.

`Applicant’s ‘2 1 7 Application includes a declaration signed by its attorney stating that
`
`“to the best of his/her knowledge and beliefno other person, firm, corporation, or association has the
`
`right to use the mark in commerce, either in identical form thereof or in such near resemblance
`
`thereto as to be likely, when used on or in connection with the goods/services of such other person,
`
`to cause confusion, or to cause mistake, or to deceive; and that all statements made of his/her own
`
`knowledge are true; and that all statements made on information and belief are believed to be true.”
`

`
`Applicant’s attorney was clearly in a position to know (or to inquire) as to whether the
`
`claims made in the ‘2 l 7 Application were false, but failed to make a reasonable inquiry as to whether
`
`Applicant, at the time of application, in fact was using Applicant’s Mark, and if so, whether such use
`
`was in interstate or international commerce and on or in connection with every item of goods
`
`specified in the application.
`

`
`Reasonably relying on the truth of the foregoing materially false representations, the
`
`United States Patent and Trademark Office (“PTO”) approved the ‘2 l 7 Application for publication.
`
`11.
`
`Upon information and belief, the conduct of Applicant and its attorney constitutes
`
`fraud on the PTO and therefore Application Serial No. 77/238,217 should not be allowed to become
`
`registered.
`
`Count II — Abandonment
`
`12.
`
`Upon information and belief, according to the online records of the California
`
`Secretary of State (a printout dated March 20, 2008 is attached as Exhibit B), Applicant has been
`
`dissolved, and sold the restaurant business to a new proprietor at the 9358 Westminster Boulevard
`
`address, Rach Gia, Inc. (a printout dated May 28, 2008 is attached as Exhibit C), which new
`
`proprietor does not use the CHAU DOC mark, but is using a different trade name LO BANH HOI
`
`RACH GIA TAN CHAU for restaurant services, and different trademark TAN CHAU on raw
`

`noodles goods that are sold to local area markets and other restaurants (printouts of digital photos
`
`recently taken by Opposer showing the new proprietor’s marks are attached as Exhibit D).
`
`13.
`
`Upon information and belief, Applicant is not, in fact, currently using Applicant’s
`
`Mark in interstate or international commerce, though the ‘217 Application was filed on a Section
`
`1(a) “use in commerce” basis, not a Section l(b) “intent to use” basis.
`
`l4.
`
`Because Applicant apparently no longer exists and is not using Applicant’s Mark, to
`
`the extent Applicant might claim rights in Applicant’s Mark, such mark has, in effect, been
`
`“abandoned” by Applicant and should not be allowed to become registered.
`
`Count III — Likelihood of Confusion - § 2(d)
`
`l5.
`
`Applicant’s Mark is essentially identical to Opposer’s Mark and so closely resembles
`
`Opposer’s Mark that the use and registration thereof is likely to cause confusion, mistake and
`
`deception as to the source or origin of Applicant’s goods and will injure and damage Opposer and
`
`the goodwill and reputation symbolized by Opposer’s Mark.
`
`16.
`
`Applicant’s goods are related to Opposer’s goods such that the public is likely to be
`
`confused or deceived, or will erroneously assume that Applicant’s goods are those ofOpposer or that
`
`Applicant is in some way connected to, sponsored by or affiliated with Opposer, all to Opposer’s
`
`irreparable damage.
`
`17.
`
`Contrary to the suggestion created by Applicant’s alleged use of Applicant’s Mark,
`
`Opposer is neither affiliated with nor a sponsor of Applicant or its goods, nor is Applicant’s use of
`
`such mark pursuant to Opposer’s consent or permission.
`
`l8.
`
`If Applicant were permitted to use and register its mark for its goods as specified in
`
`the ‘217 Application, confusion in trade resulting in damage and injury to the Opposer would be
`
`caused and would result by reason ofthe similarity between Applicant’s Mark and Opposer’s Mark.

`Persons familiar with Opposer’s Mark would be likely to buy Applicant’s goods as and for a product
`
`made and sold by Opposer. Any such confusion in trade inevitably would result in a loss of sales to
`
`Opposer. Furthermore, any defect, objection, or fault found with Applicant’s products marketed
`
`under its mark would necessarily reflect upon and seriously injure the reputation that Opposer has
`
`established for its products sold under Opposer’s Mark.
`
`19.
`
`If Applicant were granted the registration herein opposed, Applicant would thereby
`
`obtain at least a prima facie exclusive right to the use of its mark. Such registration would be a
`
`source of damage and injury to Opposer.
`
`Count IV — Dilution
`
`20.
`
`Registration and use of Applicant’s Mark would cause dilution of the distinctive
`
`quality of Opposer’s Mark.
`
`WHEREFORE, Opposer requests that registration of Applicant's Mark, Application Serial
`
`No. 77/238,217, be denied and that this Opposition be sustained in favor of Opposer.
`
`Opposer appoints Philip R. Zender, Esq., a member of the State Bar of California and the
`
`firm of Squire, Sanders & Dempsey L.L.P., One Maritime Plaza, Suite 300, San Francisco,
