`of the mark CATCH THE SPARK as shown in Application Serial No. 77/208991 (the “CATCH

`THE SPARK Mark”) filed by Shocking Technologies, Inc. (“Applicant”) and hereby opposes
`
`same.

`Opposer alleges the following grounds for opposition:

`Applicant applied to register the CATCH TH]-3 SPARK Mark as a trademark for:

`2007 based on an intent to use under Section 1(b) of the Trademark Act.

`Opposer owns incontestable U.S. Trademark Registration Nos. 1591728, 1715120, and
`
`1737259 (the “SPARC Registrations”) for its trademark SPARC (the “SPARC Trademark”).
`
`The SPARC Registrations cover: “computer hardware, namely microprocessors, central
`
`processing units, circuit boards and integrated circuits” and “computer programs for business
`
`applications and for operating systems” in Class 9, and “consultation in the field of computer
`
`hardware, software and programs” in Class 42.
`

`The SPARC Trademark has been in continuous use in commerce on the goods set forth in
`
`Registration Nos. 1591728 and 1715120 since 1987 and 1988, respectively, and on the services
`
`set forth in Registration No. 1737259 since 1990. Registration Nos. 1591728 and 1715120 for
`
`Class 9 goods were federally registered on April 17, 1990 and September 15, 1992, respectively
`
`and federally registered on December 1, 1992 for the Class 42 services. Through Opposer’s
`
`efforts, the SPARC Trademark has become a widely recognized and well-known symbol of high-
`
`quality goods.

`Opposer holds numerous additional registrations and applications for marks incorporating
`
`I the SPARC Trademark, including SPARC, Reg. No. 1664103; SPARCSERVER, Reg.
`
`No. 1992779; SPARCLE, Reg. No. 3112556; SPARCBLADE, Reg. No. 2860851;
`
`SPARCENGINE, Reg. No. 2377564; SPARCBOOK, Reg. No. 1930143; SPARCLITE, Reg.
`
`No. 1852980; SPARC DRIVEN, Reg. No. 2445011; SPARC INTERNATIONAL, Reg.
`
`No. 1684099; SPARC 64, Reg. No. 2188380; MICRO-SPARC, Reg. No. 1198516;
`
`OPENSPARC, Reg. No. 3559049; SPARC ENTERPRISE, Reg. No. 3483699; ULTRASPARC,

`Reg. No. 3079267; and ULTRASPARC DRIVEN (& Design), Reg. No. 3066067, all for goods

`and services related to those set forth in the SPARC Registrations.

`Opposer adopted and has been using in interstate commerce the SPARC Trademark in

`connection with the goods set forth in the SPARC Registrations and related goods and services
`well before the June 18, 2007 filing date ofApplicant’s intent to use application for the CATCH
`
`THE SPARK Mark.

`The CATCH THE SPARK Mark is highly similar to the SPARC Trademark and the
`
`respective goods and services on which the marks are used are highly related and are sold
`
`through the same trade channels.

`Applicant’s CATCH THE SPARK Mark is likely to cause confusion mistake or deceit of

`Accordingly, the Catch the Spark Mark is confusingly similar to the SPARC Trademark
