`Delaware with a principal place of business at 220 Continental Drive, Newark, Delaware.
`
`Opposer is a wholly-owned subsidiary of Henry Schein, Inc., the world’s largest distributor of
`
`healthcare products to office-based practitioners. Opposer is the trademark-owning entity for
`
`Henry Schein, Inc. businesses worldwide (Opposer and Henry Schein, Inc. together hereinafter
`

`referred to as “Schein”). Schein believes that it will be damaged by registration of the mark
`
`MISCELLANEOUS DESIGN (the “Ridley S Logo Mark”) as shown in the above-identified
`
`application and hereby opposes the same.
`
`The grounds for opposition are as follows:
`
`1. Schein is a FORTUNE 500® publicly-traded company and the world’s largest
`
`distributor of healthcare products and services to office-based practitioners in the
`
`combined North American and European markets. Schein serves more than a half
`
`million customers worldwide, including nearly half of the 250,000 U.S. office-
`
`based physician practices, surgical centers and other alternate-care sites. It also
`
`serves more than 85% of the dental practices in North America.
`
`2. In addition to its prominence in the medical and dental industries, Schein is the
`
`nation’s largest distributor of companion animal health supplies to veterinarians.
`
`Opposer services over 75% of the estimated 27,000 U.S. animal health practices
`
`and offers approximately 22,000 animal health products in stock as well as a large
`
`variety of special-order items.
`
`3. Its reach in the medical, dental and animal health industries is ever-growing.
`
`Schein’s net sales in 2009 reached approximately $3.9 billion USD in the United
`
`States, for a total of $6.9 billion USD worldwide.
`
`4. Among the many trademarks owned by Schein is its Henry Schein S Logo design
`
`pictured below (hereinafter the “S Logo”).

`5. Schein has used the S Logo in connection with a wide variety of dental, medical
`
`and veterinary related goods and services (the “Schein Products”) since as early
`
`as 1983 and the S Logo is featured on all Schein Products. Schein owns
`
`registrations for the S Logo for a wide range of medical goods and services in
`
`classes such as 3, 5, 9, 10, 16, 35, 36, 37, 42 and 44, including U.S. Registration
`
`Nos. 1,996,491; 1,942,625; 1,938, 682; 1,937,275; 1, 937, 276; 1, 941,020;
`
`1,959,988; 2,075,549; 2,415,807; 2,843,292; 2,845,052; 2,895,715; 2,895,717;
`
`2,895,720; 2,895,722; 2,895,723; 2,895,788 and 2,910,828 (see Exhibit A).
`
`6. Opposer’s Schein Products are sold nationwide and are enormously well known
`
`and popular in the United States medical, dental and animal health industries.
`
`The S Logo is exclusively associated with Schein by relevant consumers. As
`
`such, Opposer has established good will and fame of inestimable value in the S
`
`Logo.
`
`7. The S Logo has developed secondary meaning and significance in the minds of
`
`the relevant public, and the goods and/or services bearing the S Logo are
`
`immediately identified with Opposer, or at a minimum, as products coming from
`
`a single, albeit anonymous, source.
`
`8. On information and belief, Ridley, Inc. (“Applicant”) is in the business of
`
`manufacturing and distributing animal nutrition and health products and services
`

`to meat, milk and egg producers, and companion animal and equine owners
`
`throughout North America. Applicant’s products include complete feed and
`
`premixes, meal, pellets and blocks. Further, some of Applicant’s products bearing
`
`the Ridley S Logo Mark are marketed and sold directly to veterinarians.
`
`9. Applicant filed a use-based trademark application for the Ridley S Logo Mark on
`
`December 1, 2009 for “Animal feed supplements and medicated animal feed” in
`
`International Class 5. Applicant alleges a first use in commerce date of March 20,
`
`2003.
`
`10. Schein clearly has priority of use over Applicant, whose first use in commerce
`
`date is long subsequent to Schein’s first use and registration of the S Logo.
`
`11. Applicant’s Ridley S Logo Mark is confusingly similar in appearance to the S
`
`Logo, which the public exclusively associates with Schein and the Schein
`
`Products.
`
`12. The design element included in Applicant’s Ridley S Logo Mark consists of a
`
`nearly identical copy of Schein’s S Logo. Further, Opposer’s S Logo has long
`
`been used with blue and red color scheme and Applicant has adopted a similar
`
`blue and red color scheme for its Ridley S Logo Mark. The close resemblance of
`
`the logos’ to each other will cause confusion or cause consumers to believe that
`
`Opposer has sponsored, authorized or endorsed the quality of Applicant’s goods.
`
`13. On information and belief, Applicant adopted and applied for the Ridley S Logo
`
`Mark, with knowledge of Opposer’s world famous S Logo, and with the intent to
`
`trade on the reputation of the Schein Products.
`

`14. Applicant’s registration and use of the Ridley S Logo Mark is likely to create
`
`confusion and deceive purchasers into believing that Applicant’s goods and/or
`
`services originate with or are in some way sponsored, endorsed, licensed,
`
`associated or otherwise authorized or connected with Schein. Such confusion
`
`would irreparably harm and damage Opposer because Opposer has no control
`
`over the nature or quality of the goods and/or services provided or produced by
`
`Applicant under the Ridley S Logo Mark.
`
`15. Registration of Applicant’s Ridley S Logo Mark is also likely to lead to dilution
`
`of the distinctive and famous S Logo.
`
`16. For all of the foregoing reasons, Opposer will be damaged by Applicant’s
`
`registration of the Ridley S Logo Mark.
`
`
`
`WHEREFORE, Opposer respectfully requests that this Opposition be sustained and that
`
`the registration by Applicant of the proposed Ridley S Logo Mark be refused.
