`RESPONSE TO ORDER REGARDING MOTION TO SUSPEND PROCEEDINGS

`In response to the Board’s order dated November 15, 2011, Applicant attaches hereto copies
`of a stipulated dismissal and a docket notice from the U.S. District Court for the Northern District of
`Illinois, indicating that the plaintiff’ s action in Blue Cross and Blue Shield Association vs. UHS of
`Delaware, Inc., UHS of Texoma, Inc., Texomacare, Universal Health Services, Inc. and DOES 1-10,
`09-CV-7935, (N.D. Ill. 2009) has been dismissed with prejudice as of August 1, 2011. The dismissal
`was filed pursuant to a confidential settlement agreement between Applicant and Blue Cross and
`Blue Shield Association.
`
`As part of that confidential settlement agreement, and in a separate Board proceeding
`(Opposition No. 91195727) related to the present application, Applicant sought amendment of the
`present application, and ultimately filed a stipulated dismissal of Opposition No. 91195727 on
`October 6, 2011 (as part of a stipulated dismissal of the consolidated proceedings under Opposition
`No. 91193105). The Board then dismissed Opposition No. 91195727 with prejudice on October 17,
`2011.
`
`Between the time of the Board’s dismissal of Opposition No. 91195727 and Applicant’s
`motion filed November 15, 2011, counsel for Applicant and Opposer discussed the underlying
`dispute and considered continued suspension of the present matter to be appropriate in light of the
`progress of settlement discussions. Applicant regrets any delay in providing notice to the Board
`regarding the conclusion of the above civil action; however, the underlying settlement necessitated
`action in related Opposition No. 91195727, which was not resolved until October 17, 2011. As
`Opposer in the present opposition has consented to further suspension of the present matter pending
`settlement discussions, Applicant respectfully requests that the present Opposition remain suspended
`while Opposer and Applicant continue settlement discussions.
