`Johnson Publishing Company, Inc., an Illinois corporation, Johnson Publishing Company,

`LLC, a Delaware limited liability company, and Johnson Holding Company Inc all with their

`principal place of business at 820 South Michigan Avenue, Chicago, Illinois 60605 (collectively,
`
`“Opposer”), believes it will be damaged by registration of Application No. 85182917 for
`
`WWW.EBONYNUPTIALS.COM, and therefore opposes same. Opposer obtained an extension
`of time to oppose registration of WWW.EBONYNUPTIALS.COM through and including
`
`August 31, 2011. As grounds for opposition, Opposer alleges that:

`Benjamin Mahan dba www.EbonyNuptials.com, identified in USPTO records as an
`
`individual located at 15785 Asbury Park, Detroit Michigan 48227 (“Applicant”), filed an
`
`application for the mark WWW.EBONYNUPTIALS.COM on November 22, 2010, based on
`
`actual use.

`The application was published in the Official Gazette on May 3, 2011, covering “Dating
`
`services, namely, providing an on-line computer database featuring single people interested in
`
`meeting other single people” in International Class 45.
`
`3.
`
`Since 1945, Opposer has published magazines, books and other printed materials of
`
`general interest, which are sold and distributed throughout the United States under the trademark
`
`EBONY.
`
`4.
`
`Opposer publishes magazines, books and other printed materials, online and offline, which
`
`regularly feature articles, information, photographs, and data on African-American singles eligible
`
`for friendships, dating, marriage and other social interactions.
`
`5.
`
`In the United States, Opposer is the current owner of numerous registrations, applications
`
`and common law rights for a family of EBONY marks, the first use and filing dates of which all
`
`precede Applicant’s filing date. Opposer’s marks include:

`Opposer’s registrations, applications and common law rights in EBONY remain valid and

`owned in the name of Opposer.

`Opposer has standing to bring this opposition.

`Applicant seeks to obtain a registration for the mark WWWEBONYNUPTIALSCOM in

`International Class 45, for “Dating services, namely, providing an on-line computer database
`
`featuring single people interested in meeting other single people.”
`

`Opposer owns EBONY registrations and common law rights that cover goods and services
`
`that are similar or related to the services in Applicant's opposed application.
`

`
`Opposer owns a pending application for EBONY (Application Serial No. 77270798,
`
`attached as Exhibit B) with a priority date before any priority date by Applicant. This application
`
`covers goods and services including in Class 45, that are similar or related to the services in
`
`Applicant's opposed application, which establishes Opposer’s prior intent to use the EBONY mark
`
`for similar or related services.

`Since at least as early as September 4, 2007, which was before Applicant’s filing date,
`
`Opposer established an intent to use the EBONY mark on a wide variety of beauty, leisure and
`
`entertainment goods and services for African—Americans, including wedding or nuptial-related
`
`goods and services, particularly for African—American singles.
`

`
`Since at least as early as 2007, which was before Applicant’s filing date, Opposer has
`
`provided a web site featuring on-line publications on health, finance, beauty, fashion, cosmetics
`
`and personal care for men and women, home design, lifestyles, African—American artists and
`
`subjects of interest to African-Americans.
`

`For over 20 years prior to Applicant’s filing date, Opposer has used its EBONY mark for
`
`goods and services targeted to single African—Americans, such as Opposer’s EBONY Bachelors
`
`and Bachelorettes and EBONY Sexy Singles features, which allow interested parties to interact
`
`electronically and via social media.
`

`
`Since at least as early as 1945, which was prior to Applicant’s filing date, Opposer has
`
`offered, manufactured, marketed, sold, and distributed beauty, leisure and entertainment goods and
`
`services for African—Americans, including wedding or nuptial-related goods or services that are
`
`similar or related to the services in Applicant's opposed application.
`

`Opposer first used its EBONY mark in commerce at least as early as 1945 for magazines,
`
`featuring articles, information, photographs, on African-American singles and wedded couples,
`
`and expanded its use of the EBONY mark to other printed matter such as books, specialty
`
`publications, greeting cards and beauty calendars featuring African-American singles, long prior
`
`to Applicant’s November 22, 2010 filing date for WWW.EBONYNUPTIALS.COM.
`

`
`Beginning at least as early as 1958, Opposer organized and sponsored beauty and cultural
`
`events for African-Americans throughout the United States under the trademark EBONY, such as
`
`EBONY FASHION FAIR which toured the United States for 50 years, and currently sponsors
`
`cultural programs of interest to African-Americans.
`

`
`Opposer first used its EBONY mark in commerce for cultural events for African-
`
`Americans, at least as early as 1958, long prior to Applicant’s November 22, 2010 filing date for
`
`WWW.EBONYNUPTIALS.COM.
`
`17.
`
`Many of Opposer’s EBONY cultural events and online goods and services are advertised
`
`using images or photographs of its target audience, namely African-American men and women.
`
`Applicant's mark suggests that Applicant’s services are either targeted to African-Americans or
`
`produced by African-Americans, and thus increases the likelihood of confusion as to source.

`Opposer’s EBONY mark became well-known long prior to Applicant’s November 22,
`
`2010 filing date for WWW.EBONYNUPTIALS.COM.
`
`19.
`
`Having first used its EBONY mark in commerce since at least as early as 1945, Opposer’s
`
`use in commerce predates Applicant’s November 22, 2010 filing date for
`
`WWW.EBONYNUPTIALS.COM, by approximately sixty-five (65) years.
`
`20.
`
`The services of Applicant and goods and services of Opposer are similar and related, and
`
`feature similar content directed to the same target audience.
`
`21.
`
`Opposer offers its goods and services via online websites and online publications under the
`
`EBONY mark, through websites that are accessible throughout the United States.
`
`22.
`
`Applicant purports to offer its services via an online website that is accessible throughout
`
`the United States.
`
`23.
`
`Applicant’s WWW.EBONYNUPTIALS.COM mark seeks to take advantage of the
`
`goodwill of Opposer’s famous EBONY mark for online services focused on or of interest to
`
`African-Americans.
`
`24.
`
`Applicant’s mark WWW.EBONYNUPTIALS.COM is so similar to Opposer’s mark
`
`EBONY as to create a likelihood of confusion in violation of 15 U.S.C. § 1052(d).
`
`25.
`
`The primary commercial impression of Applicant’s WWW.EBONYNUPTIALS.COM
`
`mark is that of EBONY.
`
`26.
`
`Applicant’s mark WWW.EBONYNUPTIALS.COM is likely to deceive consumers as to
`
`source, sponsorship or affiliation of the parties and the parties’ respective goods and services, all
`
`in violation of 15 U.S.C. § 1052(d).
`

`
`Upon infonnation and belief, Applicant was not using the applied for mark for the applied
`
`services, at or before the time of the application, and therefore the application is void ab irzitio, in
`
`violation of 15 U.S.C. §1051(a).

`Upon information and belief, Applicant was not using the applied for mark as a trademark
`
`or service mark for the applied services, at or before the time of the application, and therefore the
`
`application is void ab initio, in violation of 15 U.S.C. §1051(a).

`The grant of registration to Applicant of its WWW.EBONYNUPTIALS.COM mark would
`
`blur, could tarnish and would thereby dilute the fame of Opposer’s mark, in violation of 15 U.S.C.
`
`§ 1125(c).

`
`The grant of registration to Applicant of its WWW.EBONYNUPTIALS.COM mark would
`
`create statutory rights in Applicant in violation and derogation of the established prior rights of
`
`Opposer, resulting in harm, detriment and damage to Opposer.
`
`WHEREFORE, Opposer Johnson Publishing Company, lnc., Johnson Publishing
`
`Company, LLC, and Johnson Holding Company Inc pray that Application Serial No. 85182917 be
`
`rejected, that no registration be issued thereunder to Applicant Benjamin Mahan dba
`
`www.EbonyNuptials.com, and that this opposition be sustained in their favor.
