`Despite the fact that AOL Inc. ("AOL") and Verizon Communications Inc. ("Verizon")

`recently announced the signing of an agreement for Verizon to purchase AOL, the parties to this

`opposition have continued to negotiate and consider a draft settlement agreement. AOL and
`
`London Stock Exchange have made comments on the draft agreement and will use the 60-day
`
`suspension to continue efforts to move toward a mutually-agreeable resolution. The parties plan
`

`to have regular settlement phone calls and other communications during the suspension to
`
`negotiate toward a resolution.

`Defendant has consented to the granting of this suspension.
