`Publix Asset Management Company believes it will be damaged by registration to Anthony P.

`Mendola (“Mendola”) ofthe word mark SUBLIX for restaurant services featuring sub sandwiches and
`
`hereby opposes registration ofthat mark. As grounds for this opposition, Publix Asset Management
`
`Company alleges:
`
`Background
`
`1.
`
`Publix Asset Management Company and Publix Super Markets, Inc. (collectively “Publix”)
`
`are related corporations duly organized and existing under the laws of the State of Florida. Their principal
`
`place of business is in Lakeland, Florida.
`
`2.
`
`Upon information and belief, Mendola is an individual and United States citizen,
`
`with an address of 2535 NE 36”‘ Ave., Ocala, Florida 34470.
`
`3.
`
`Publix Super Markets, Inc, is the largest and fastest-growing employee—owned
`
`supermarket company in the United States. Founded in 1930, Publix Super Markets, lnc., has
`
`grown into a Fortune 500 company with more than 1,000 stores.
`

`
`Publix Asset Management Company owns numerous trademarks and uses them
`
`through Publix Super Markets, Inc., and other related companies.
`
`5.
`
`For example, Publix Asset Management Company owns the following PUBLIX
`
`trademark registrations:
`
`0 Reg. No. 3,774,700, for café and restaurant services, with a first—use date of May 1, 1988;
`
`0 Reg. No. 3,774,699, for retail delicatessen services, with a first—use date of 1961;
`
`0 Reg. No. 1,339,762, for retail grocery store services, with a first—use date of December 31,
`1930;
`
`0 Reg. No. 3,774,764, for retail bakery services; retail florist services, with a first—use date of
`November 8, 1940;
`
`0 Reg. No. 3,359,127 for retail store services, featuring liquor, beer and wine, with a first—use
`date of March 1, 2004;
`
`0 Reg. No., 1,370,458, for beverages, namely purified drinking water, fruit juices, carbonated
`soft drinks, with a first—use date of January 2, 1985;
`
`0 Reg. No., 1,824,506, for food products; namely milk, evaporated milk, canned fruits,
`canned vegetables, applesauce, tomato paste, peanut butter, dry roasted peanuts, apple jelly,
`olives, vegetable oil, turkey breasts, mayonnaise and non—dairy creamer, with a first—use
`date oflanuary 2, 1985;

`0 Reg. No. 1,391,014, for food products, namely coffee, tea, salt, cake cups for ice cream,
`snack crackers, spaghetti, elbow macaroni, rice, breakfast cereal, ice cream, ketchup and
`fiuit pies, with a first—use date of January 2, 1985;
`
`0 Reg. No. 1,389,315, for canned and dried cat food, and dried dog food, with a first—use date
`ofJanuary 2, 1985;
`
`0 Reg. No. 1,382,948, for deodorant, hair shampoo, hair conditioner, denture cleanser, nail
`polish remover, with a first-use date of January 2, 1985;
`
`0 Reg. No. 1,797,499, for vitamins, mineral supplements, isopropyl alcohol, aspirin,
`antihistamine, nasal decongestant, petroleum jelly for medicinal use, cotton swabs for
`medicinal use, with a first—use date of January 2, 1985;
`
`0 Reg. No. 1,772,104, for pharmacy services, with a first—use date of November 17, 1991;
`
`0 Reg. No. 2,739,635, for financial services, namely, automated teller machine services, with
`a first—use date of December 31, 1982;
`

`Serial No. 85/843,752, a use-based application for batteries, with a first-use date of 1994;
`and
`
`Serial No. 85/850,175, a use-based application for retail and online store services featuring
`outdoor furniture, namely, patio furniture, fire pits, grills, benches, hammocks, shade
`canopies, portable gazebos, lawn chairs, beach chairs, and beach umbrellas, with a first-use
`date of 1997.

`PTO information concerning these registrations is attached as Composite Exhibit A.
`

`In addition to the rights conferred by these registrations, Publix Asset Management
`
`Company has established common law rights through use ofthe PUBLIX mark for numerous
`
`goods and services.
`
`7.
`
`The PUBLIX mark identifies a broad variety of goods and services offered by
`
`Publix, including (a) restaurant services allowing customers to order and eat custom-prepared
`
`foods, including sub sandwiches, in sections of Publix grocery stores that offer restaurant-style
`
`seating, (b) delicatessen services allowing customers to order custom-prepared sandwiches and
`
`delicatessen items, including sub sandwiches, for take—out or in-store consumption; (0) bakery
`
`services, including breads and rolls used in Publix delicatessen departments and restaurants to
`
`prepare sandwiches, including sub sandwiches; and (d) goods such as lunchmeats, produce,
`
`bakery products, condiments and other food products commonly used in sandwiches, including sub
`
`sandwiches, prepared in Publix delicatessens and restaurants.
`

`
`PUBLIX goods and services are offered in restaurant and delicatessen sections
`
`within PubliX’s PUBLIX brand stores. The mark appears on labels, signs, in advertising, and on
`
`point-of-purchase displays. The mark points consumers to sandwiches prepared using PubliX’s
`
`own private-label PUBLIX products, as well as goods from others whose products meet Publix’s
`
`standards. These sandwiches and other products are sold for in-store consumption in restaurant
`
`seating areas or for takeout.
`
`9.
`
`Publix’s is particularly known for its delicatessen services, which include the
`

`preparation of sub sandwiches for consumption at in—store restaurant seating areas and for takeout.
`
`10.
`
`Publix has used the PUBLIX mark in commerce on delicatessen services since at
`
`least as early as 1961.
`
`Mendola ’s application
`
`11.
`
`The SUBLIX application was published for opposition on February 26, 2013.
`
`Publix Asset Management Company requested and was granted a 90-day extension of time in
`
`which to oppose the application. This opposition, therefore, is timely.
`
`The marks are confusingly similar
`
`12.
`
`Mendola’s application identifies the goods on which he intends to use the
`
`SUBLIX mark as restaurant services featuring sub sandwiches.
`
`13.
`
`Sub sandwiches are sold in Publix stores under the PUBLIX brand for
`
`consumption at in-store restaurant seating areas and for takeout. -
`
`14.
`
`I Mendola’s SUBLIX application was filed more than twenty—five years after
`
`Publix filed its first PUBLIX application.
`
`15.
`
`Mendola’s SUBLIX application was filed approximately more than fifty years
`
`after Publix first used PUBLIX on delicatessen services and more than eighty years after Publix
`
`first used PUBLIX in commerce.
`
`16.
`
`Mendola’s planned mark SUBLIX mark is confusingly similar to PUBLIX, a
`
`well-established brand name that Publix uses to identify its own goods and services, including
`
`the preparation and sale of sub sandwiches (among other things). Under these circumstances,
`
`consumer confusion is quite likely.
`
`17.
`
`In particular, confusion is likely because the marks at issue are so similar.
`
`Mendola’s mark changes only the first letter of the PUBLIX mark, replacing the “P” with an “S.”
`
`

`
`The mark SUBLIX is obviously designed to benefit from the goodwill established by Publix in
`
`its PUBLIX mark.
`
`18.
`
`Mendola’s proposed mark is quite similar in sight, sound, and meaning to the
`
`PUBLIX mark. This similarity is likely to cause confusion.
`
`19.
`
`The strength of the PUBLIX mark also supports a finding that confusion is likely.
`
`Publix has used the PUBLIX mark since 1930, and the PTO has long recognized the
`
`incontestability of Publix’s rights in PUBLIX for retail grocery store services, cafe’ and restaurant
`
`services, and delicatessen services. See Reg. Nos. 1,339,762, 3,774,700, and 3,774,699.
`
`Because these registrations are incontestable, the PUBLIX mark is presumptively strong. See
`
`Aut0Z0ne, Inc. v. Tandy Corp, 373 F.3d 786, 794 (6th Cir. 2004) (incontestable marks are
`
`presumed to be strong marks); Wynn Oil Ca. V. American Way Service Corp., 943 F.2d 595, 600
`
`(6th Cir. 1991) (equating mark’s incontestability with strength). “Strong marks are given strong
`
`protection over a wide range of related products and services.” Turner Greenberg Assoc, Inc. v.
`
`C & Clmports. Inc, 320 F. Supp. 2d 1317, 1332 (S.D. Fla. 2004) (citing John H. Harland C0.
`
`Clarke Checks, Inc., 711 F.2d 966, 973 (11th Cir. 1983)). The PUBLIX mark has been the
`
`subject of extensive marketing and advertising. As a result, the PUB LIX mark is strong and
`
`famous. That strength supports a finding that confusion is likely if Mendo1a’s proposed mark is
`
`registered.
`
`20.
`
`In addition, Mendola’s proposed services goods are sufficiently similar to those of
`
`Publix to cause confusion. Publix operates more than 1,000 retail stores with delicatessens that
`
`make and sell sub sandwiches. In those stores, Publix uses the PUBLIX mark to identify
`
`delicatessen services that include making sub sandwiches. Publix also uses the PUBLIX marks
`
`on ready-made sub sandwiches for purchase by grocery store customers who choose not to wait
`
`

`for a custom-made sandwich. Many Publix stores include in—store restaurant seating areas where
`
`customers eat sub sandwiches made at the delicatessen counter and purchase beverages and side
`
`items. Publix stores also prepare sub sandwiches for takeout. Similarly, Mendola plans to offer
`
`restaurant services featuring sub sandwiches, and likely would also sell beverages and side items.
`
`Thus Publix’s services and Mendola’s planned services are almost identical.
`
`21.
`
`Finally, because Mendola filed an intent-to-use application, a lack of actual
`
`confusion at this point would not be significant. The Patent & Trademark Office is not required
`
`to wait for confusion to occur before rejecting a proposed confusing mark.
`
`22.
`
`For all of these reasons, Mendola’s planned SUBLIX mark is likely to cause
`
`confusion with Publix’s Very similar PUBLIX mark.
`
`Damage to Publix
`
`23.
`
`Publix believes that it would be damaged by registration of SUBLIX to Mendola.
`
`As discussed above, PUBLIX is the company’s primary mark that has been used extensively for
`
`many years. Registration of SUBLIX to Mendola would constitute prima facie evidence that
`
`Mendola has an exclusive right to use SUBLIX to refer to services that are identical to Publix’s
`
`services. Such an exclusive right would be inconsistent with Publix’s established exclusive right to use
`
`PUBLIX to refer to its services.
`
`

`
`Conclusion
`
`Publix will be damaged by registration of the mark shown in Serial No. 85/738,463 and,
`
`therefore, opposes registration.
