`Opposer believes that it will be damaged by the registration of Applicant's

`proposed mark and opposes Applicant's application for the following reasons:

`a.

`Applicant's proposed mark, ROXYLEAN, is confusingly similar

`to Opposer's Mark by its incorporation and clear emphasis of the term "Roxy." Moreover,
`
`Applicant intends to use its proposed mark on goods and services that fall within Opposer's
`
`natural zone of expansion. Such similarity is likely to cause confusion, to cause mistake, and to
`
`deceive the public, injuring Opposer and the consuming public.

`b.
`
`Applicant may intend to gain notoriety and financial success by
`
`confusing the public by using Opposer's similar mark that has afforded Opposer a reputation of
`
`excellence.

`c.
`
`Such use will also dilute the distinctive and famous nature of

`Opposer's ROXY® Mark.
