`333 Continental Boulevard, El Segundo, California 90245 (hereinafter “Mattel” or “Opposer”),

`believes it will be damaged by registration of the mark shown in Application Serial No.

`86/732,019 filed August 20, 2015 and published in the Official Gazette on January 19, 2016, and

`hereby opposes same.

`As grounds for opposition it is alleged that:

`Mattel and its family of companies is a manufacturer of consumer products and is

`one of the most successful manufacturers and marketers of toys, games and playthings in the
`
`world. Mattel was founded in 1945 and has earned a reputation for producing high-quality
`
`goods.

`Since at least as early as May 1958, Mattel has continuously used the trademark
`
`BARBIE® in connection with the manufacture, advertising and sale of toys, games and
`
`playthings, as well as related products and services. Mattel has also extensively licensed use of
`
`its BARBIE® mark for a wide variety of goods and services.

`Prior to any date of first use upon which applicant can rely, Mattel, itself, and/or
`
`through licensees, has used the BARBIE® mark on or in connection with goods including, but
`
`not limited to, soaps, toiletries, and cosmetics, jewelry, watches, apparel and fashion accessories,
`
`doll accessories and playsets, hair and cosmetic brushes, hairbands and ribbons, series of books
`
`and printed articles, coloring books, activity books, printed puzzles and greeting cards, pre-
`
`recorded computer gaming cartridges, musical, audio and video sound recordings, and interactive
`
`multi-media computer game programs, journals and magazines, bags and backpacks, linens,
`
`cookware, and computer application software for mobile phones and mobile devices.

`Prior to any date of first use upon which applicant can rely, Mattel, itself, and/or

`through licensees, has used the BARBIE® mark on or in connection with services including, but

`not limited to, retail store departments featuring consumer products, entertainment services in the

`nature of live appearances by a costumed character, entertainment services in the nature of
`
`providing computer games that can be accessed and played over interactive television,
`
`broadband, satellite, cable, television networks, online retail store services, providing
`
`information over a global computer network featuring games and stories, and chat sessions,
`
`providing online information about dolls, games and collectables, providing educational and
`
`entertainment services via a global computer network website featuring product trivia and
`
`product information, production distribution of motion picture films and television programs,
