`(Interpeace)(hereinafter, “Interpeace”) is a Switzerland
`
`association with an address at Chemin de Balexert 7-9, CH-1219
`
`Châtelaine, Switzerland. Interpeace believes that it would be
`
`damaged by the registration of the mark pictured above and shown
`

`in Application Serial No. 87/136,637 (“Applicant’s Mark”) with
`
`respect to the International Class 36 services, and hereby
`
`opposes the same under the provision of Section 13 of the
`
`Trademark Act of July 5, 1946, as amended, 15 U.S.C. § 1063.
`
`As grounds of opposition, it is alleged that:
`
`OPPOSER’S EXCLUSIVE RIGHTS
`
`1. Opposer is the exclusive owner of all rights, title
`
`and interest in U.S. Trademark Reg. Nos. 3,472,520 for
`
`; 3,472,521 for
`
`;
`
`and 4,801,651 for
`
` (“Opposer’s
`
`Marks”). U.S. Trademark Reg. No. 3,472,520 identifies Opposer’s
`
`rights in its
`
` mark with respect to charitable
`
`fundraising and financial management services in International
`
`
`

`Class 36, among other goods and services. See Exhibit A for
`
`trademark and service mark registrations owned by Opposer.
`
`2. Opposer, through its predecessors and related
`
`peacebuilding institutions, has engaged in a wide variety of
`
`marketing, fundraising, charitable work, and education under
`
`Opposer’s Marks. Opposer has made continuous and extensive use
`
`of Opposer’s Marks, which use has developed widespread public
`
`recognition and appeal, since at least as early as 2006.
`
`3. Opposer is a non-governmental peacebuilding organization
`
`that was established by the United Nations in 1994 and
`
`transitioned into an independent organization and strategic
`
`partner of the United Nations in 2000. Opposer has offices in
`
`seven countries and has launched its peacebuilding initiatives
`
`in over 21 countries to date.
`
`4.
`
`Opposer establishes peacebuilding initiatives in
`
`conflict-ridden countries through its “Track 6 Approach,” which
`
`integrates local communities, civil society, and government into
`
`the peace-building process. This integration ensures that the
`
`needs of all facets of society are reflected in the policies
`
`that rebuild an unstable country, which contributes to the
`
`legitimacy and long-term effectiveness of those policies.
`

`Opposer has established a “Constitution-making”
`
`program as part of its initiatives, in order to facilitate
`
`constitution-making that promotes inclusion, gender equality,
`
`
`

`participation, and transparency. As part of this program,
`
`Opposer provides localities with guidance, knowledge, resources,
`
`and connections with experts in constitution-making.
`

`The fame of Opposer’s Marks is reflected in its donor
`
`base, partnerships, awards, and global presence. Opposer is
`
`funded by, among others, the European Union, the United Nations,
`
`and various governmental departments or agencies of Canada,
`
`Denmark, Finland, France, Germany, Ireland, the Netherlands,
`
`Norway, Qatar, Sweden, Switzerland, and the United Kingdom. In
`
`2008, the then Chairman of the Interpeace Governing Council,
`
`Martti Ahtisaari, was awarded the UNESCO Peace Prize. Each year
`
`on International Peace Day, a day established by the United
`
`Nations General Assembly, Interpeace co-organizes the Geneva
`
`Peace Talks with the United Nations Office at Geneva and the
`
`Geneva Peacebuilding Platform, and hosts various local events
`
`around the globe to promote discussions on peace. In 2010,
`
`Opposer received a ZEWO certification, an accreditation awarded
`
`to charitable organizations that meet rigorous standards for
`
`efficient and transparent use of donations.
`
`7.
`
`Opposer's registrations are valid and subsisting and
`
`are conclusive evidence of Opposer's exclusive right to use
`
`Opposer’s Marks in commerce for charitable fundraising and
`
`financial management.
`
`
`

`Through extensive and continuous use of its brand, the
`
`Opposer’s Marks have acquired substantial goodwill in connection
`
`with charitable fundraising and financial management.
`
`9.
`
`Opposer's extensive marketing, promotion, and use of
`
`Opposer’s Marks has caused donors, governments, foundations,
`
`multilateral organizations customers, non-governmental and non-
`
`profit institutions, and the public generally to immediately
`
`associate the Opposer’s Marks with Opposer and to expect a wide
`
`variety of goods and services to have a connection with, or
`
`association with, Opposer.
`
`APPLICANT’S MARK
`
`10. On August 12, 2016, Applicant filed U.S. Application
`
`No. 87/136,637 for registration of Applicant’s Mark, listing
`
`among its services “Charitable fundraising; Charitable services,
`
`namely, providing financial support to disadvantaged individuals
`
`in the United States and other countries for the purpose of
`
`facilitating health, wellness and economic developments” in
`
`International Class 36. Applicant’s Mark was published for
`
`opposition in the Official Gazette dated October 25, 2016. See
`
`printout from the United States Patent and Trademark Office
`
`database attached as Exhibit B.
`
`11. Applicant’s basis for filing Applicant’s Mark in
`
`International Class 36 is alleged use in commerce since June 14,
`
`2010.
`

`12. Opposer's use of Opposer’s Mark in connection with
`
`services in International Class 36 predates Applicant's
`
`application filing date by at least 4 years.
`
`13. Opposer's use of Opposer’s Mark in connection with
`
`services in International Class 36 predates Applicant's alleged
`
`date of first use in commerce by at least 4 years.
`
`14. Applicant's Mark is confusingly similar in appearance
`
`to Opposer's Mark because both marks depict two figures facing
`
`each other with outstretched arms and the figures are nearly
`
`identical in appearance.
`
`15. In the application, Applicant declares that it offers
`
`the same services as Opposer, namely charitable services in
`
`International Class 36.
`
`16. The use and registration of Applicant's Mark to
`
`identify its International Class 36 services is likely to cause
`
`confusion, mistake, and deception as to the source, origin,
`
`sponsorship, or association of the services, and is likely to
`
`mislead the public, potential donors, and potential aid
`
`recipients into believing that Applicant is licensed or
`
`controlled by Opposer or that Applicant is in some way related
`
`to or affiliated with Opposer.
`
`17. Any defects, objections or faults found with the
`
`International Class 36 services offered by Applicant under
`
`Applicant's Mark, because of the false association with Opposer,
`
`
`

`would inflict upon and seriously injure the reputation of
`
`Opposer.
`
`18. If Applicant is granted the registration herein
`
`opposed in International Class 36, it would thereby obtain at
`
`least a prima facie exclusive right to the use of the
`
`Applicant’s Mark in connection with International Class 36
`
`services. Such registration would be a source of damage and
`
`injury to Opposer, as well as confusion in the relevant
`
`marketplace.
`
`19. The grant of a Certificate of Registration to
`
`Applicant for Applicant’s Mark in International Class 36 would
`
`be inconsistent with and in derogation of Opposer's prior rights
`
`and would therefore cause damage and injury to Opposer and
`
`deception of and confusion to the public.
`
`
`
`APPLICANT’S MARK IS LIKELY TO CAUSE CONFUSION
`
`AS TO SOURCE, ORIGIN, SPONSORSHIP, OR AFFILIATION
`
`20. In view of the similarity in overall commercial
`
`impression of the respective marks, the related nature of the
`
`services of the respective parties in International Class 36,
`
`and Opposer's priority as to use of the mark, Opposer alleges
`
`that Applicant's Mark so resembles Opposer’s Mark as to be
`
`likely to cause confusion, or mistake, or to deceive under
`
`Trademark Act Sections 2(d), 15 U.S.C. Section 1052(d), and will
`
`
`

`cause damage to Opposer and its goodwill represented by its
`
`prior-used marks.
`
`21. In addition, Opposer's rights and fame in its marks,
`
`including those based on its extensive use, registrations, and
`
`public recognition, were established long before Applicant
`
`commenced use of and filed its application for its mark in
`
`International Class 36. Thus, granting registration to Applicant
`
`in International Class 36 would diminish and dilute the
`
`distinctive quality of Opposer's rights in its famous marks in
`
`violation of Trademark Act Section 43(c), 15 U.S.C. Section
`
`1125(c), and could also in the event of any mishaps involving,
`
`or poor quality of, the services offered by Applicant, tarnish
`
`such distinctiveness.
`
`APPLICANT'S MARK IS LIKELY TO DILUTE THE DISTINCTIVE
`
`QUALITY OF OPPOSER’S FAMOUS MARKS
`
`
`22. At all times prior to both Applicant’s application to
`
`register Applicant’s Mark and any use of Applicant’s Mark by
`
`Applicant, Opposer’s Marks were distinctive and had already
`
`become famous.
`
`23. The fame and high degree of recognition afforded to
`
`Applicant’s Mark is evident in the significant duration, extent
`
`and geographic reach of marketing and services bearing the
`
`marks; widespread recognition of Opposer’s Mark among non-profit
`
`and non-governmental organizations; and the registrations of
`
`Opposer’s Mark accorded on the Principal Register.

`24. That Applicant’s Mark is likely to cause dilution by
`
`blurring is evident in the high degree of similarity between
`
`Applicant’s Mark and Opposer’s Mark; the high degree of inherent
`
`and acquired distinctiveness of Opposer’s Mark; the
`
`substantially exclusive use of Opposer’s Mark to promote its
`
`charitable services in International Class 36; the extraordinary
`
`degree of recognition accorded to Opposer’s Mark among non-
`
`governmental and non-profit organizations; the apparent intent
`
`of Applicant to create an association with Opposer’s Mark; and
`
`any actual association between Applicant’s Mark and Opposer’s
`
`Mark that would be established during discovery.
`
`25. The use and registration of Applicant's Mark to
`
`identify its services, after Opposer’s Mark had become famous,
`
`is therefore likely to cause dilution by blurring of Opposer’s
`
`Mark, regardless of the presence or absence of actual or likely
`
`confusion, competition, or of actual economic injury, and will
`
`injure Opposer.
`
`For the reasons set forth in the foregoing paragraphs one
`
`through twenty-five, Opposer believes that it would be damaged
`
`by the registration of Applicant's Mark in connection with the
`
`services in International Class 36, and thus Applicant should be
`
`denied registration of the mark in International Class 36.
`
`WHEREFORE, Opposer prays that this opposition be sustained
`
`and that Application Serial No. 87/136,637 be refused
`
