`
`Michael Webster, Interlocutory Attorney:
`
`
`On May 1, 2017, Opposer filed a motion to strike Applicant’s affirmative defenses. On
`
`May 15, 2017, Opposer filed a stipulated motion to suspend the proceeding for 90 days
`
`pending settlement negotiations. Because the parties are negotiating for a possible
`
`settlement of this case, proceedings are suspended for 90 days, subject to the right of
`
`either party to request resumption at any time.1 See Trademark Rule 2.117(c).
`
`In view of the 90-day suspension, the Board has reset the deadline for Applicant to
`
`file a response to Opposer’s motion to strike to August 19, 2017, ninety (90) days from
`
`the original due date.2 Upon filing a response to the motion to strike, the Board will re-
`
`suspend the proceeding pending disposition of the motion to strike.
`
`
`1 The parties should note that if proceedings are suspended for a lengthy period of time
`pursuant to the filing of several motions to suspend for settlement, the Board retains
`discretion to condition the approval of any future consented or stipulated motion to suspend
`on a party or the parties providing necessary information about the status of settlement talks,
`discovery activities, or trial activities, as may be appropriate. Trademark Rule 2.117(c).
`2 The parties requested that the Board reset the due date for Applicant’s response to the
`motion at July 15, 2017, which the parties erroneously identified as 90 days from the original

`
`If, during the suspension period, either of the parties or their attorneys have a change
`
`of address or email address, the Board should be so informed.

`
`
`deadline. However, the original deadline for the response was May 21, 2017. See Trademark
`Rule 2.127(a) (a response to a motion shall be filed within 20 days of the date of service of the
`motion). Accordingly, the Applicant’s amended due date is 90 days after May 21, 2017.
