`Opposer, FCA US LLC, formerly Chrysler Group LLC (“Opposer”), a Delaware limited liability
`
`company, with a principal place of business at 1000 Chrysler Drive in Auburn Hills, Michigan 48236,
`
`believes that it will be damaged by the registration of the trademark shown in United States Trademark
`
`Application Serial No. 87/761,650 in the name of Somar Motor, LLC, a Florida limited liability
`
`company, with an address of 1321 Eastern Pecan PI Unit 101, Winter Garden, Florida 34787, and
`
`therefore, opposes registration of this trademark under the provisions of Section 13 of the Trademark
`
`Act of 1946, 15 U.S.C. § 1063, and Rule 2.101 of the Trademark Rules of Practice, 37 C.F.R. § 2.101.

`As grounds for this opposition, Opposer alleges the following:

`Opposer is the owner of numerous U.S. Registrations for the JEEP® trademark which are
`
`valid, subsisting and incontestable including, but not limited to, U.S. Registration No. 526,175 for
`
`“JEEP”, registered on the Principal Register on June 13, 1950, in Class 12 for “automobiles and
`
`structural parts thereof”; U.S. Registration No. 1,081,322 for “JEEP”, registered on the Principal
`
`Register on January 3, 1978, in Class 37 for “automobile vehicle repair and maintenance service”; and
`
`MILLER,CANFIELD,PADDOCKANDSTONE,P.L.C.

`U.S. Registration No. 820,237 for “JEEPSTER”, registered on the Principal Register on December 13,
`
`1966, in Class 12 for “automobiles and structural parts thereof.”
`

`In addition to the goods identified above, Opposer’s JEEP® brand trademark
`
`registrations cover numerous consumer goods including, but not limited to, knives, forks, spoons,
`
`combs, sponges, glassware, cleaning instruments, jewelry, toys, watches, clocks, tents, sleeping bags,
`
`eyeglasses, sunglasses, strollers, mugs, insulated beverage containers, footwear, backpacks, luggage,
`
`stickers, decals, flashlights and blankets. Opposer has also used the JEEP® trademark on numerous
`
`other products including, but not limited to, notebooks, journals, calendars, art prints, posters, pens,
`
`messenger bags, key chains, video games, golf balls, coasters, cell phone covers, go-carts, bicycles and
`
`flower arrangements.
`

`Opposer is also the owner of numerous U.S. Registrations, which are valid, subsisting
`
`and incontestable, for its famous and distinctive elongated vertical slot grille designs which are
`
`incorporated into its JEEP® brand vehicles, including, but not limited to, U.S. Registration Nos.
`
`2,924,936, 2,823,099, 2,732,021, 2,161,779, 2,794,553, and 2,764,249 (collectively, the designs and
`
`registrations are referred to as the “JEEP® Grille Design”), which are registered on the Principal
`
`Register for the structural parts of motor vehicles in Class 12.
`

`In addition, Opposer owns Trademark Registration No. 4,272,873, for a stylized
`
`silhouette of a JEEP® Wrangler® vehicle:
`
`MILLER,CANFIELD,PADDOCKANDSTONE,P.L.C.
`
`5.
`
`Opposer owns additional rights respecting the overall look and feel of its most famous
`
`JEEP® brand model: the iconic JEEP® Wrangler®. Opposer owns certain trade dress rights in specific
`
`Wrangler® vehicle features including, but not limited to, its boxy body shape, a grille with vertical
`

`elongated grille slots and round headlamps positioned on the upper part of the grille with the trapezoidal
`
`or keystone-like grille outline curving around them and the trapezoidal wheel wells (collectively along
`
`with Reg. No. 4,272,873, the “Wrangler® Trade Dress”).

`Opposer has used its JEEP® trademark in connection with “automobiles and structural
`
`parts thereof” in Class 12 continuously for over 75 years.
`
`7.
`
`Opposer has used its JEEP® trademark in connection with “automobile vehicle repair
`
`and maintenance service” in Class 37 continuously since at least as early as 1978.
`
`8.
`
`Opposer has used its JEEPSTER® trademark in connection with “automobiles and
`
`structural parts thereof” in Class 12 continuously since at least as early as 1943.
`
`9.
`
`Opposer has used its JEEP® Grille Design in connection with structural parts for motor
`
`vehicles in Class 12 continuously since at least as early as 2001 (Opposer’s JEEP®, JEEPSTER® and
`
`JEEP® Grille Design are hereinafter collectively referred to as the “JEEP® brand trademarks”).
`

`Opposer has used the Wrangler® Trade Dress for decades for the vehicle, with the result
`
`that the public associates the design exclusively with the JEEP® brand.
`

`
`Opposer’s goods and services sold under the JEEP® brand trademarks and the
`
`MILLER,CANFIELD,PADDOCKANDSTONE,P.L.C.
`
`Wrangler® Trade Dress have been continuously sold and advertised in the United States for decades.
`
`As a result, Opposer has built up valuable goodwill in the JEEP® brand trademarks and the Wrangler®
`
`Trade Dress, the JEEP® brand trademarks and the Wrangler® Trade Dress have become a symbol of
`
`Opposer and an indicator of the source of Opposer’s goods and services, and the JEEP® brand
`
`trademarks and the Wrangler® Trade Dress have become famous in the United States.
`

`On January 19, 2018, Applicant filed an application for registration of the mark SOMAR
`
`MOTOR & design, U.S. Serial No. 87/761,650, in Class 35 for “on-line wholesale and retail store
`
`services featuring automotive parts and accessories” with a first date of use in commerce of January 1,
`
`2018. Applicant’s mark incorporates elements of both Opposer’s JEEP® Grille Design and Opposer’s
`

`which contains the famous JEEP® Grille Mark and Wrangler® Trade Dress, prominently display
`
`photographs of JEEP® Wrangler® vehicles and slogans featuring the JEEP® trademark, such as “House

`It is clear that Applicant’s goal is to associate its goods services with the JEEP® brand.

`In fact, Applicant’s services are marketed to owners of JEEP® brand vehicles.

`Applicant’s SOMAR MOTOR & design mark so resembles Opposer’s JEEP® Grille
`
`Design and the Wrangler® Trade Dress so as to be likely, when applied to Applicant’s services, to cause
`
`a likelihood of confusion or to mistake or deceive purchasers as to the source of Applicant’s services,
`
`because of Opposer’s prior use and registration of the famous JEEP® Grille Design and the Wrangler®
`
`Trade Dress in connection with the sale of the same or similar goods and services as those sold by
`
`Applicant under its mark. In addition, Applicant’s deliberate action of using slogans that contains the
`
`famous JEEP® trademark, prominently featuring JEEP® Wrangler® vehicles on its websites and related
`
`social media accounts, and attempting to associate its services with the JEEP® brand by marketing its
`

`services to owners of JEEP® brand vehicles further increases the likelihood of confusion with
`
`Opposer’s famous JEEP® brand trademarks and the Wrangler® Trade Dress.

`Opposer will be damaged by the registration of Applicant’s mark in view of the

`likelihood of confusion such registration will cause as to the source of Opposer’s and Applicant’s

`Opposer will also be damaged by the registration of Applicant’s mark because

`Applicant’s mark will dilute the distinctive quality of Opposer’s famous JEEP® brand trademarks and

`the Wrangler® Trade Dress.

`WHEREFORE, it is respectfully requested that the opposition be sustained and registration of
`
`Application Serial No. 87/761,650 be refused registration.
