`that is the subject of U.S. Application Serial No. 87/887,384 (“Application”), and hereby

`opposes its registration under Lanham Act Section 13, 15 U.S.C. § 1063, and Trademark Rule

`2.101, 37 C.F.R. § 2.101 on the following grounds:

`FACTUAL BACKGROUND REGARDING OPPOSER AND ITS MARKS

`Opposer ACT is an Iowa corporation, having its principal place of business at 500

`ACT Drive, P.O. Box 168, Iowa City, Iowa 52243-0168.

`Opposer owns the registered marks ACT (standard character mark), ACT (typed

`drawing), ACTNEXT, ACT TESSERA, ACT HOLISTIC FRAMEWORK, ACT

`ASSESSMENT, AIM ACT INFORMATION MANAGER, ACT NATIONAL CURRICULUM

`Additionally, Opposer has pending applications for the marks ACT STACK (standard character
`
`mark) and ACT STACK (stylized).

`Opposer’s Family of Marks are used across a broad range of services and services
`
`employed to provide innovative educational, testing, career, and workforce training, assessment
`
`and counseling programs and materials, as well as research related thereto. Opposer also uses
`
`the ACT Family of Marks in the promotion and marketing of its educational, testing, career, and
`
`workforce development systems.

`Opposer has continuously used the marks within its ACT Family of Marks since
`
`at least as early as 1959, long before the filing date of the Application.

`Opposer is the owner of record of the incontestable registered trademark/service
`
`mark ACT (typed drawing), U.S. Registration No. 2,888,069, U.S. Application Serial No.
`
`75/692,325, filed on April 27, 1999, for (1) “pre-recorded compact discs, video and audio
`
`cassettes, and educational and administrative software featuring instruction, information, tests,
`
`proficiency and professional assessments, and administrative assistance, all for one or more of
`
`the following purposes, namely, education and career planning, post-secondary admissions,
`
`academic advising, course placement, educational research, test development, educational and
`
`occupational testing, test scoring and reporting, test administration, student aptitude and
`
`achievement testing, student evaluation, instructional assessment and training, curriculum
`
`development, language proficiency assessment, need analysis, certification and professional
`
`licensing, professional assessment, and career guidance, all for use in the field of education from
`
`primary through postgraduate levels and instructional manuals therefore sold as a unit” in
`
