`Whereas, Elda’s Kitchen, LLC a Delaware limited liability company (“Elda’s”), has applied for
`registration of the trademark GIMME THAT in International Class 30 with a Serial No. 8859416?
`(“Mark”); and

`Whereas, Elda’s desires to voluntarily withdraw the application for registration of the Mark; and

`Whereas, Gimme Health Foods, Inc, a California corporation (“Gimme Health”), has filed an
`opposition to registration of the Mark (“Opposition”).

`Now, therefore, Elda’s voluntarily submits this request for withdrawal of its application to register the
