`Novus International, Inc., a corporation organized under the laws of Delaware, having a

`place of business at 20 Research Park Drive, St. Charles, Missouri 63304 (hereinafter “Novus
`
`International” or “Opposer”) believes it will be damaged by the registration of the above-
`
`identified mark and hereby opposes same pursuant to the provisions of 15 U.S.C. § 1063.

`As grounds for this opposition it is alleged that:

`goods and services, making and offering for sale a wide range of nutritional products throughout

`the United States.

`as well as marketing and other informational material, in various types of media, related to its

`referred to herein as the “Opposer’s Marks”. The goods and services offered for sale and

`covered under Opposer’s Marks are referred to as “Opposer’s Products and Services.” Copies of
`
`Novus International’s registration certificates and printouts from the U.S. Patent and Trademark
`
`Office database showing the current title and status of Opposer’s Registrations are attached
`
`hereto as Exhibits A-D. Under 15 U.S. Code § 1115, Opposer’s Registrations are prima facie
`
`evidence of the validity of the registered marks, of the registrations of the marks, of Novus
`

`International’s ownership of the marks, and of Novus International’s exclusive right to use
`
`Opposer’s Marks in commerce on or in connection with the goods or services specified in the
`
`registrations.

`Novus International has expended significant resources in marketing, advertising,
`
`and promoting Opposer’s Marks and, through such sales and advertising, has generated
`
`substantial goodwill and consumer recognition in Opposer’s Marks.
`
`6.
`
`Novus International has derived substantial revenue from its sales of Opposer’s
`
`Products and Services under Opposer’s Marks.
`
`7.
`
`On information and belief, PowerPlant Foods Inc. (“Applicant”) is an Oregon
`
`corporation with a place of business at 5933 NE Win Sivers Dr., Ste. 205, Portland, Oregon
`
`97220.
`
`8.
`
`On September 16, 2019, Applicant filed an intent-to-use trademark application to
`
`register NOVUS (the “Subject Mark”) in connection with “Nutritional supplement energy bars;
`
`Powdered nutritional supplement drink mix containing protein; nutritional supplement shakes; all
`
`of the foregoing non-medicated and intended for human consumption,” in International Class 5
`
`which was assigned Serial No. 88/618,513 (the “Subject Application”).
`

`The Subject Application was published for opposition on August 11, 2020.
`
`Therefore, this Notice of Opposition is timely filed.
`
`10.
`
`Applicant’s filing of the Subject Application and Applicant’s use of the Subject
`
`Mark are without the consent or permission of Novus International.
`

`
`There is no issue as to priority. Applicant filed the Subject Application based on
`
`an alleged intention to use the Subject Mark and has not filed an amendment to allege use as of
`
`the filing date of this Notice of Opposition.

`Upon information and belief, Applicant has acquired no rights in the Subject
`
`Mark in the United States that pre-date Opposer’s first use of Opposer’s Marks.
`
`13.
`
`Upon information and belief, Applicant does not own an application to register
`
`the Subject Mark, or any other mark similar thereto, that pre-dates Opposer’s first use of
`
`Opposer’s Marks.
`
`14.
`
`Opposer’s common law rights in Opposer’s Marks predate the filing date of the
`
`Subject Application and any date of first use upon which Applicant may rely.
`
`15.
`
`The Subject Mark is identical in sight, sound, connotation, and overall
`
`commercial impression to Opposer’s Marks.
`
`16.
`
`Due to the distinctive nature of Opposer’s Marks in connection with Opposer’s
`
`Products and Services, the Subject Mark so resembles Opposer’s Mark that the Subject Mark,
`
`when used in connection with the goods covered by the Subject Application, is likely to cause
`
`confusion, to cause mistake, or to deceive. Purchasers and prospective purchasers are likely to
`
`mistakenly believe that the products Applicant offers under the Subject Mark are produced,
`
`sponsored, endorsed, or approved by Novus International, or are in some way affiliated,
`
`connected, or associated with Opposer or Opposer’s Marks and brand, all to the detriment of
`
`Novus International. As a result of the substantial marketing and sales of the Opposer’s Products
`
`and Services under Opposer’s Marks, such products and services have come to be, and now are,
`
`well and favorably known under Opposer’s Marks as products and services of high quality.
`
`Opposer’s Marks are distinctive of Opposer’s Products and Services and valuable goodwill has
`
`been built up in Opposer’s Marks.
`

`Registration of the Subject Mark would be a further source of damage to Novus
`
`International, as it would confer upon Applicant various statutory presumptions to which it is not
`

`entitled in view of Opposer’s prior rights in Opposer’s Marks.

`WHEREFORE, pursuant to Section 13 of the Lanham Act, 15 U.S.C. § 1063, Novus

`International respectfully requests that its opposition be sustained and that registration of the

`mark shown in Application Serial No. 88/618,513 be refused. The statutory opposition filing fee
`
`of $400 is submitted herewith.
