`principal place of business at 106 N. Lee Street, Second Floor, Alexandria, Virginia 22314

`(hereinafter “Opposer”), believes that it will be damaged by registration of the mark GREY
`
`MATTER and Design
`
` shown in Serial No. 88438262 (“Opposed
`
`Application” or “Opposed Mark”), as filed by Reliaquest, LLC, a Florida limited liability
`
`company, having an address at 777 S. Harbour Island Blvd., Suite 500, Tampa, Florida 33602
`
`(hereinafter “Applicant”), and hereby opposes registration of that mark. The Opposed
`
`Application was published on September 29, 2020, and Opposer requested a 30-day extension of
`
`time to oppose on October 28, 2020. This Notice of Opposition is being timely filed.
`
`
`
`As grounds for opposition, it is alleged that:
`
`1. Opposer owns a registration for the mark GREY MATTER (Reg. No. 5724827), filed on
`
`January 31, 2018, published on January 29, 2019, and granted on April 16, 2019, for
`
`
`

`“computer software used to develop microservices and microservices architecture;
`
`computer software for use in developing, deploying, customizing and managing
`
`microservices software applications; computer software for use in securing, managing,
`
`and extending application programming interfaces (APIs) and microservices; computer
`
`software for use in artificial intelligence for IT operations (“AIOps”) and MESH
`
`networks; computer software for use in managing wireless mesh networks (“Opposer’s
`
`Goods”). First use of this mark anywhere and in commerce is claimed since at least as
`
`early as September 1, 2017. A printout from the USPTO TSDR database evidencing the
`
`current status and copy of the pleaded registration is annexed as Exhibit A.
`
`2. Opposer is a platform developer whose flagship service mesh platform GREY MATTER
`
`provides infrastructure and network management for enterprise IT operations. Opposer’s
`
`GREY MATTER computer software platform simplifies microservice and multi-cloud
`
`design, development, and control, and provides AI-enabled monitoring and responses to
`
`enterprise IT computer systems and services. Opposer’s platform facilitates scalable,
`
`enterprise-ready applications, provides secure and trusted storage access APIs, offers
`
`zero-trust security in protecting sensitive systems and communications from cyber
`
`threats, and enhances security of IT systems through the secure compartmentalization of
`
`system-wide content and in-depth API monitoring. The security framework of Opposer’s
`
`platform oversees the vital activities of user-authentication and access control, service
`
`discovery, data policy management and governance throughout a hybrid cloud mesh
`
`while allowing service mesh developers and analysts to focus on enhancing business
`
`capabilities.

`3. Opposer was ranked 126th and Top 10 in the D.C. Metro Area on Deloitte’s Technology
`
`Fast 500, a ranking of the 500 fastest growing technology, media, telecommunications,
`
`life sciences and energy tech companies in North America, now in its 52nd year.
`
`“Deloitte’s Technology Fast 500 provides a ranking of the fastest-growing technology,
`
`media, telecommunications, life sciences and energy tech companies – both public and
`
`private – in North America. Technology Fast 500 award winners are selected based on
`
`percentage fiscal year revenue growth from 2015 to 2018. In order to be eligible for
`
`Technology Fast 500 recognition, companies must own proprietary intellectual property
`
`or technology that is sold to customers in products that contribute to a majority of the
`
`company’s operating revenues. Companies must have base-year operating revenues of at
`
`least U.S. $50,000 and current-year operating revenues of at least U.S. $5 million.
`
`Additionally, companies must be in business for a minimum of four years and be
`
`headquartered within North America.”
`
`4. In addition to Opposer’s recognition as a member of the Deloitte Fast 500, Opposer was
`
`listed as one of CIO Review’s 20 Most Promising Enterprise Architecture (EA)
`
`Technology Providers of 2019. CIO Review cited Opposer as one of the EA solutions
`
`providers that “streamline business processes and define the path to success” for
`
`enterprise architecture.” CIO Review also pointed to the emergence of AI as a disruptive
`
`force in EA operational insight and process automation. Opposer’s GREY MATTER
`
`software platform is built with AI in mind, leveraging a powerful underlying content
`
`delivery network (CDN) to capture service mesh data for in-depth analysis and to power
`
`machine learning enabled network operations management and automation.

`5. Opposer has been recognized locally as one of the D.C. Metro Area’s 75 Fastest-Growing
`
`Companies by Washington Business Journal.
`
`6. Opposer was selected as one of DC Inno’s “50 on Fire” in 2019, highlighting 50 people
`
`and companies that have contributed to the District’s innovation economy, including a
`
`big funding round, product launch, growth milestone, big hire, successful pivot, or all of
`
`the above.
`
`7. Opposer is active on the presentation and conference circuit, bringing its GREY
`
`MATTER software platform to a number of industry trade events. Opposer presented its
`
`GREY MATTER software platform at InfoCon’s June 2019 NYC QCon, providing a talk
`
`on its path to service mesh architecture and support; and at the DoDIIS Conference on
`
`August 18-21, 2019, in Tampa Bay, Florida. Opposer presented talks on its GREY
`
`MATTER software’s zero-trust security at SPIFFE Community Day in October 2019, at
`
`the 2019 Gartner Symposium held October 20-24, 2019, in Orlando, Florida, and at the
`
`Cloud Native Computing Foundation’s KubeCon event on November 18-21, 2019, in San
`
`Diego, California. At EnvoyCon 2020 on October 15, 2020, Opposer shared real-world
`
`experiences running COVID API Hub, a collection of COVID-19 datasets publicly
`
`exposed by a production deployment of its GREY MATTER software platform.
`
`8. On May 20, 2019, Applicant filed the Opposed Application to register the mark
`
`GREYMATTER and Design
`
` (“Applicant’s Mark” or
`
`“Opposed Mark”) for platform as a service (PAAS) featuring software platforms for
`
`security surveillance that allow for the use of practical and accurate algorithms to
`
`automate the filtering process around event types that are less relevant and less actionable
`
`to security that are not necessary to process in traditional security technologies, namely,
`
`
`

`the security information and event management (SIEM) and to learn the difference
`
`between normal and abnormal user behavior, specific to that distinctive organization.
`
`Applicant claims first use of the Opposed Mark since January 14, 2019.
`
`9. The literal portion of Applicant’s Mark GREYMATTER is phonetically, visually, and
`
`legally identical to Opposer’s Mark GREY MATTER, and conveys identical commercial
`
`impressions. Moreover, Applicant has adopted the identical British-English spelling of
`
`the first term “GREY” with the letter “E” rather than the letter “A” as in the American-
`
`English spelling, “GRAY.” The absence of a space between the words GREY and
`
`MATTER in Applicant’s mark has no consequence in differentiating the meaning, sound,
`
`or connotation of the mark, and fails to distinguish the Applicant’s Mark from Opposer’s
`
`Mark GREY MATTER.
`
`10. Opposer’s software platform offered under Opposer’s Mark GREY MATTER is highly
`
`related and complementary to Applicant’s software platform offered under the
`
`Applicant’s Mark GREY MATTER and Design,
`
`, performs
`
`highly related if not identical functions, and is used and marketed similarly, to identical
`
`and highly related industries, to similar classes of consumers.
`
`11. Upon information and belief, Applicant has described its GREYMATTER product as “its
`
`SaaS platform for increasing enterprise visibility while automating threat detection and
`
`response. It does this by unifying and integrating existing SIEM, EDR, multi-cloud, and
`
`third-party apSps, to deliver a centralized, transparent view across the environment.”
`

`12. Opposer’s GREY MATTER platform simplifies decentralized network management of
`
`the enterprise, builds numerous autonomous services for security, workflow, algorithms,
`
`and data management, which together enable an AI driven network. Opposer’s GREY
`
`MATTER platform optimizes user experiences, multiple client channels, cloud-native
`
`performance, AI decision making and continuous delivery.
`
`13. Upon information and belief, according to Applicant’s website, Applicant’s
`
`GREYMATTER platform’s “analytics provide actionable reporting and metrics that
`
`measure ongoing improvement of the security model so teams can recognize and
`

`14. Opposer’s GREY MATTER platform captures metrics via decentralized data streaming,
`
`which are synced and stored for in-depth service level analysis, and which can be used to
`
`produce service level overlays set to enterprise’s specifications. Logging, monitoring,
`
`and data retention are all modeled and programmed via observables related to actions
`
`across service mesh from application to infrastructure.
`
`15. Upon information and belief, Applicant claims its GREYMATTER product “proactively
`
`identif[ies] and address[es] cybersecurity threats across an organization so that security
`
`teams can mobilize faster and more effective responses.” Exhibit C:

`18. Opposer’s GREY MATTER platform manifests event-driven pipelines and data flows in

`support of data insights, contextual cues, and analytics, and its containers and

`function level isolate anomalies and re-route traffic at a code level. Opposer’s GREY
`
`MATTER Dashboard presents an intuitive single-touchpoint interface displaying service
`
`mesh control and data plane operations. Opposer’s GREY MATTER software platform
`
`publishes these events for storage and analysis making security analysis and resource
`
`change tracking simpler and troubleshooting across service mesh and enterprise more
`
`cost-effective.
`
`19. Upon information and belief, Applicant claims its GREYMATTER platform improves
`
`security posture with machine learning-driven automated hunts and automated attack
`
`simulations to validate security controls and systems, identify gaps, and prioritize
`

`20. Opposer’s GREY MATTER software platform features predictive network operational

`overlapping classes of purchasers so that purchasers, potential purchasers, users and
`
`others are likely to be confused, mistaken or deceived into the belief that Applicant’s
`
`goods/services offered under the mark GREYMATTER emanate from and/or are in some
`
`way sponsored or approved by Opposer, or are related in some way with Opposer,
`
`thereby damaging Opposer.
`
`22. Upon information and belief, Applicant cannot claim use of the Opposed Mark GREY
`
`MATTER and Design
`
`before January 14, 2019.
`
`, anywhere or in interstate commerce,

`23. Opposer’s date of first use, September 1, 2017, precedes any date of first use that can be

`claimed by Applicant of the Opposed Mark GREYMATTER and Design

`25. Therefore, as between the parties to this Opposition, Opposer is the senior user of the

`ownership and exclusive right to use Opposer’s Mark GREY MATTER in commerce,

`and is constructive notice of Opposer’s ownership thereof, as provided by §§ 7(b) and 22
`
`of the Trademark Act of 1946.

`28. Upon information and belief, Applicant knew or should have known of Opposer’s prior
`
`use and registration of its mark GREY MATTER at the time that Applicant adopted the

`mark GREYMATTER and Design

` and filed Application

`Serial No. 88438262 on May 20, 2019 seeking to register that mark.
`
`29. By virtue of Opposer’s prior use of the mark GREY MATTER, and its maintenance of
`
`high quality standards relating thereto, purchasers, consumers, and users of such goods,

`and others in the industry, have come to recognize the mark GREY MATTER as an
`
`indication of origin in Opposer, as a consequence of which Opposer has established
`
`valuable goodwill and exclusive rights in the mark GREY MATTER.

`30. Applicant is not lawfully entitled to the registration which it seeks for the reasons, inter
`
`alia, that the mark GREYMATTER and Design

`on or in connection with the goods/services of the Applicant, is likely to cause confusion,

`mistake, or to deceive, in violation of Section 2(d) of the Trademark Act, 15 USC
