`of the mark “THINQ” (“Applicant’s Mark”), depicted in U.S. Application Serial No.

`88/441,702 (the “Application”), filed May 22, 2019, by LG Electronics Inc., a Korean
`
`corporation. Accordingly, Lenovo PC International Ltd. hereby opposes registration of

`Applicant’s Mark, and as grounds for opposition alleges as follows:

`Opposer, Lenovo PC International Ltd., is a limited liability company organized

`under the laws of Hong Kong and located at 23/F Lincoln House, 979 King’s Road, Quarry Bay,

`from International Business Machines Corp. (“IBM”) in 2005.

`IBM adopted and began using the mark THINK PAD in connection with

`computers in or around 1992. The THINK PAD mark has been used continuously since that date
`
`for a variety of computers and computer-related goods and services, and it has been used
`
`continuously by Opposer and/or Opposer’s related companies since at least as early as 2005.

`meaning of 15 U.S.C. §§ 1065 and 1115(b).

`Through extensive use, Opposer has also acquired significant common-law rights
`
`in Opposer’s THINK Marks and has used those marks in connection with a variety of goods and
`
`services in the U.S.
`

`Opposer’s THINK Marks comprise a family of THINK-formative marks, and

`they are recognized by consumers as such.
`
`9.
`
`Collectively, Opposer’s THINK Marks cover a variety of computer hardware
`
`goods, including but not limited to, computers, computer monitors, computer peripherals, and
`
`computer accessories, along with software and related services.
`

`
`On information and belief, Applicant is a corporation organized under the laws of
`
`the Republic of Korea with an address at 128 Yeoui-daero, Yeongdeungpo-gu, Seoul, Republic
`
`of Korea 150-721.

`On May 22, 2019, Applicant filed the Application to register Applicant’s Mark
`
`(THINQ) in the USPTO for various goods in International Classes 9 and “development of
`
`operating system software for controlling electric power consumption; computer hardware and
`
`software design for energy management; rental of computer hardware and software for energy
`
`management; [and] technical advice relating to use and operation of computer hardware and
`
`software for energy management” in International Class 42 (collectively, the “Opposed Goods
`
`and Services”), among other goods and services in International Classes 4, 35, 37, 39, 40, and
`
`42.

`claiming a bona fide intent to use Applicant’s Mark in the future.

`THINK Marks arose prior to any rights that Applicant may have in Applicant’s Mark.

`Applicant’s Mark is similar to Opposer’s THINK Marks in sight, sound, and

`commercial impression.

`The Opposed Goods and Services are identical or closely related to the goods and
`
`services that Opposer offers under Opposer’s THINK Marks and that are covered by Opposer’s

`registrations for Opposer’s THINK Marks.

`Opposer in violation of Section 2(d) of the Lanham Act, 15 U.S.C. § 1052(d), with consequent
