`Nando’s Limited (“Opposer”), a company organized under the laws of England

`and Wales, with a business address at St. Marys House, 42 Vicarage Crescent, London

`SW113LD, United Kingdom, believes it is or will be damaged by registration of the mark
`
`NANO shown in U.S. Trademark Application Serial No.90/135,489 (the “Application”)
`
`filed by Tyson Foods, Inc. (“Applicant”), a Delaware corporation with a business address
`
`at 2200 Don Tyson Parkway, Springdale, Arkansas 72762, and Opposer hereby opposes
`
`the registration of said mark.
`
`The grounds for the opposition are as follows:

`1. Opposer is a reputable company that provides restaurant services, and that
`
`prepares, sells and delivers various food products, in U.S. commerce in connection with
`
`marks that consist of or contain the term NANDO’S (collectively, the “NANDO’S
`
`Marks”). The first Nando’s restaurant opened in Johannesburg, South Africa in 1987.
`
`Since that time, Nando’s has successfully expanded its operations internationally.

`Opposer and its affiliated companies successfully operate more than 1,100 restaurants in
`
`more than 20 countries around the world, including in the United States and Canada.
`

`
`2. Opposer owns and uses the NANDO’S Marks in U.S. commerce in
`
`connection with goods and services, including but not limited to restaurant services and
`
`food preparation, sale and delivery services. There have been Nando’s restaurants in the
`
`United States since 2008, and there are now 42 restaurant locations. The signature dish
`
`for which Opposer is well known is its flame-grilled peri-peri chicken.
`
`
`
`3. Opposer offers fast casual dining, and its food can be ordered in its
`
`restaurants or online. Opposer also offers catering services and sells a range of
`
`condiments and sauces for its poultry dishes under the NANDO’S Marks not only in its
`
`restaurants but also through the retail market.
`
`
`
`4. Opposer owns the following U.S. trademark registrations and an application
`
`for marks that include the term NANDO’S and no other word in connection with goods
`

`6. The NANDO’S Marks are distinctive.

`7. The registrations for the NANDO’S Marks are valid, subsisting, and prima

`facie evidence of the validity and registration of the marks, Opposer’s ownership of the

`marks, and Opposer’s exclusive right to use the marks in commerce on or in connection
`
`with the goods and services in the registrations.
`
`
`
`8. Opposer has used, advertised, and promoted the NANDO’S Marks both
`
`independently and together as a family of marks, sharing the word “NANDO’S.” As a
`
`result, consumers in the United States have come to exclusively associate the marks and
`
`the word “NANDO’S” with Opposer and its goods and services, and to understand that
`
`the goods and services offered under the NANDO’S Marks emanate from the same
`
`source, namely Opposer.
`

`
`9. Opposer and affiliated companies hold more than 400 registrations for
`
`trademarks including the word “NANDO’S” in the United States and globally.
`
`
`
`
`
`10.
`
`As a result of extensive use, advertising, and promotion, the NANDO’S
`
`Marks have become strong and well-known in the United States and elsewhere.
`
`
`
`11. Applicant owns the Application, which was filed on August 25, 2020, for
`
`the mark NANO in standard characters for “Poultry” in International Class 29 (the
`
`“NANO Mark”) and which asserts a filing basis under Section 1(b).
`

`The USPTO published the application for the NANO Mark on December
`
`1, 2020.
`
`
`
`13.
`
`On December 28, 2020, Opposer filed a request to extend the opposition
`
`deadline for the application for the NANO Mark by thirty (30) days. That request was
`
`granted the same day. On January 28, 2021, Opposer filed a request to extend the
`
`opposition deadline for the application for the NANO Mark by an additional sixty (60)
`
`days. That request was granted the same day.

`On January 31, 2021, Applicant filed a Post-Notice of Allowance
`
`Amendment to amend the class description to “Poultry sold to foodservice institutions.”
`
`
`
`15.
`
`Opposer first used the NANDO’S Marks in U.S. commerce in connection
`
`with food products, restaurant services, and the preparation, sale and delivery of food,
`
`long prior to the filing date of the NANO Mark by Applicant.
`
`
`
`16.
`
`On information and belief, Applicant has made no actual or constructive
`
`use of the NANO Mark.
`
`
`
`17.
`
`The NANO Mark so resembles the NANDO’S Marks as to be likely to
`
`cause confusion or mistake, or to deceive, in violation of Section 43(a) of the Lanham
`
`Act.
`

`
`18.
`
`On information and belief, Applicant intends to use the NANO Mark in
`
`connection with a chicken product that will be offered and sold through foodservice
`
`channels including but not limited to delis, cafeterias and restaurants. See, e.g.,

`Applicant’s Mark is visually and phonetically similar to the NANDO’S
`
`Marks.
`

`
`Given the strength and renown of the NANDO’S Marks, and Opposer’s
`
`use of the marks on food items, especially those used for Nando’s famous peri-peri
`
`chicken dishes, consumers are likely to believe that products or services bearing the
`
`NANO Mark are an extension of Opposer’s line of products and services.

`21.
`
`Specifically, Applicant is seeking registration of the NANO Mark in
`
`connection with poultry. On information and belief, Applicant intends to sell its poultry
`
`products through various channels, and such products will be offered to consumers at a

`variety of outlets including delis, cafeterias and restaurants. Because Opposer offers and
`
`sells its goods and services through similar channels and outlets, the likelihood that
`
`consumers will see the food items sold by Opposer and Applicant as related or emanating
`
`from the same source is extremely high.

`
`In view of (a) the similarities between the parties’ marks, (b) the
`
`relatedness of the goods and services offered by the parties, (c) the renown and strength
`
`of the NANDO’S Marks, and (d) the overlap of the parties’ prospective consumers,
`
`Applicant’s use of the NANO Mark is likely to cause confusion or mistake as to the
`
`source or sponsorship of Applicant’s goods.
`
`23.
`
`Consumers are likely to mistakenly believe that there is a connection
`
`between Applicant and Opposer that does not exist, or that Applicant’s goods are
`
`affiliated with, licensed or sponsored by Opposer.
`
`WHEREFORE, Opposer respectfully requests that the Trademark Trial and
`
`Appeal Board refuse to register Applicant’s NANO mark and sustain this opposition to
`
`U.S. Trademark Application Serial No. 90/135,489.
