`Monster Energy Company (“Opposer”), a Delaware corporation, located and doing

`business at 1 Monster Way, Corona, California 92879, believes that it will be damaged by
`
`registration of U.S. Trademark Application Serial No. 90/324194 (“Application”) for the mark
`
`MONSTER FAIRINGS (“Applicant’s Mark”) filed by Bentley Oliver Co (“Applicant”) and
`
`therefore opposes the same.

`As grounds for opposition, it is alleged:
`

`By the Application filed on November 17, 2020, Applicant seeks to obtain
`
`registration on the Principal Register for Applicant’s Mark for “Motorcycle helmet visors” in
`
`International Class 9 (“Applicant’s Goods”) based on Applicant’s alleged use of the mark in
`
`interstate commerce since January 1, 2014.

`Since at least 2002, long before the filing date of the Application, Opposer has
`
`been, and still is, engaged in the development, marketing, and/or sale of nutritional supplements,
`
`energy drinks, clothing, and other accessories and products under the marks MONSTER™ and
`
`MONSTER ENERGY® and related marks, all containing “MONSTER.” Opposer’s family of
`
`MONSTER Marks includes, for example, the following: MONSTERTM, MONSTER ENERGY®,
`
`MONSTER REHAB®, MUSCLE MONSTER®, MONSTER ASSAULT®, M MONSTER
`
`ENERGY®, JUICE MONSTER®, LO-CARB MONSTER ENERGY®, JAVA MONSTER®,
`
`MONSTER ARMY®, CAFFE MONSTER®, MONSTER HYDRO®,
`
`
`
`®, and
`
`® (collectively, the “MONSTER Marks”).

`Since 2002, Opposer has expanded its use of the MONSTER Marks and uses,
`
`licenses or has used or licensed these marks in connection with graphics kits, sports helmets,
`
`motorcycles, riding gloves, gear bags, ATVs, motorized vehicles, stickers, decals, automotive
`
`wheels, replica cars, remote control cars, trailer hitch covers, and other related accessories.

`Examples of authorized products bearing Opposer’s MONSTER Marks are shown below:

`Since at least before the filing date of the Application, Opposer’s family of
`
`MONSTER Marks has been the subject of substantial and continuous marketing and promotion
`
`
`

`by Opposer in connection with its beverages, sports equipment, clothing and numerous other
`
`products and services.

`There is a huge demand for shirts, t-shirts, sweatshirts, hats, jackets, stickers, decals,
`
`automotive accessories, graphics kits for motor vehicles such as motorcycles, snowmobiles, and
`
`ATVs, and other merchandise bearing Opposer’s MONSTER Marks. Opposer has licensed its
`
`MONSTER Marks to several third parties including, but not limited to, Yamaha, a large
`
`manufacturer and distributor of motorized vehicles including motorcycles, Kawasaki, a large
`
`manufacturer and distributor of motorcycles, 43 Racing LLC, a company owned by Ken Block who
`
`is a professional motocross and rallycross athlete, and Clinton Enterprises, a leading supplier of
`
`motorcycle racing merchandise. Examples of Opposer’s licensed products bearing the MONSTER
`
`Marks are shown below:

`For many years prior to the filing date of the Application, Opposer has
`
`extensively promoted its MONSTER Marks in connection with automotive events and extreme
`
`sports. Opposer promotes its MONSTER Marks in connection with a wide variety of events,
`
`including, but not limited to, Motocross, MotoGP, Supercross, Formula 1 Racing, NASCAR,
`
`Summer and Winter X Games, snow bike races and competitions, and snowmobile races and
`
`competitions such as ISOC National Snocross. At these events, Opposer’s MONSTER Marks
`
`are often prominently displayed on vehicles, signs, and athlete clothing and gear, and are often
`
`incorporated into the series logo. Examples of Opposer’s MONSTER Marks at Motorcycle
`
`events are shown below:

`Opposer has extensively promoted its MONSTER Marks in connection with
`
`sponsoring motorcycle athletes. Opposer sponsors or has sponsored athletes such as Ricky
`
`Carmichael, Jago Geerts, Julien Lieber, Darian Sanayei, Ben Watson, Aaron Plessinger, Dylan
`
`Ferrandis, Justin Barcia, Eli Tomac, Maxime Desprey, Romain Febvre, Maverick Vinales,
`
`Clement Desalle, Kiara Fontanesi, Tommy Searle, Ryan Villopoto, and Livia Lancelot in the
`
`sport of Motocross racing. In addition, Opposer sponsors or has sponsored Valentino Rossi,
`
`Fabio Quartararo, Franco Morbidelli, and Cal Crutchlow in connection with MotoGP
`
`competitions. Opposer’s MONSTER Marks are often prominently displayed on the athletes’
`
`clothing, gear, and vehicles.

`In addition to sponsoring motorcycle athletes and events, Opposer conducts
`
`promotional activities in connection with its sponsored motorcycle athletes and MONSTER
`
`Marks. Examples of Opposer’s MONSTER Marks used in motorcycle promotional activities are

`By virtue of Opposer’s continuous and substantial use, the MONSTER Marks have
`
`become famous identifiers of Opposer such that consumers have come to recognize a family of
`
`MONSTER Marks with which Opposer markets and sells its goods and services. As a result,
`
`Opposer has built up, at great expense and effort, valuable goodwill in its family of MONSTER
`
`Marks and has developed strong common law rights in Opposer’s MONSTER Marks. Opposer’s
`
`common law rights in its family of MONSTER Marks predate the filing date of the Application
`
`
`

`and the alleged date of first use in commerce of Applicant’s Mark, and Opposer relies on these
`
`common law trademark rights in this Opposition.1
