`Opposer, NIKE, Inc., a corporation of Oregon, whose address is One Bowerman Drive,

`Beaverton, Oregon 97005, believes it will be damaged by the registration of the above-identified
`
`mark, applied for on the Principal Register by Timothy Jinks, an individual whose address is 6231
`
`Hanna Court, Charlotte, NC 28212 and opposes the same.
`
`The grounds for the opposition are as follows:
`
`BACKGROUND ON OPPOSER AND ITS AIR MARKS
`
`Opposer is a leading provider of a broad range of clothing, footwear, accessories,
`

`equipment, and other products and services relating to sports, fitness, health and wellness, lifestyle,
`
`and fashion.
`

`
`Opposer is the owner of rights granted via federal registrations and common law
`
`rights for the mark “AIR” alone (hereinafter the “AIR Mark”) and in combination with other words
`
`
`
`
`
`

`and designs (the “AIR-Formative Marks”). These AIR-Formative Marks include, among others,
`
`“NIKE AIR”, “AIR MAX”, “AIR JORDAN”, “MAX AIR”, “AIR ZOOM”, “ZOOM AIR”,
`
`“AIR270”, “AIR FORCE 1”, “NIKE AIR VAPORMAX”, “AIR TRAINER MAX”, “AIR
`
`FLIGHT” and “AIR-SOLE.”
`

`Opposer has continuously used marks consisting of or incorporating the word AIR
`
`in connection with footwear and apparel in interstate commerce for decades.
`
`4.
`
`Examples of AIR Marks or AIR-Formative Marks on apparel in use over the years
`
`and continuing to today include:

`In the decades since the launch of its various product lines featuring its AIR Marks

`and AIR-Formative Marks, including iconic brands such as NIKE AIR, AIR JORDAN, AIR MAX
`
`and AIR FORCE 1, Opposer has sold hundreds of millions of pairs of shoes and apparel products
`
`branded with its AIR Marks and/or AIR-Formative Marks in the United States, grossing billions
`
`of dollars in sales.
`

`
`As a result of Opposer’s long use and substantial promotion of its AIR Marks and
`
`AIR-Formative Marks, Opposer has developed substantial goodwill in said marks, and the public
`
`has come to associate the AIR Marks and AIR-Formative Marks with the goods of Opposer.
`
`OPPOSER OWNS MULTIPLE TRADEMARK REGISTRATIONS
`FOR THE AIR MARKS AND AIR-FORMATIVE MARKS
`
`Opposer is the owner of U.S. Trademark Registration No. 2,068,075 for the mark
`
`7.
`
` for “Footwear and clothing, namely caps, socks and sweatshirts” in International Class
`
`25, registered June 3, 1997. This Registration is incontestable pursuant to Section 15 of the
`
`Lanham Act, 15 U.S.C. § 1065, and thus serves as conclusive evidence of the validity of Opposer’s
`
`mark pursuant to 15 U.S.C. § 1115(b).
`
`8.
`
`Opposer is the owner of U.S. Trademark Registration No. 6,695,024 for the mark
`
`for “Footwear” in International Class 25, registered April 5, 2022.
`
`9.
`
`Opposer is the owner of U.S. Trademark Registration No. 6,124,768 for the word
`
`mark “AIR270” for “Footwear” in International Class 25, registered August 11, 2020.
`
`10.
`
`Opposer is the owner of U.S. Trademark Registration No. 1,145,812 for the word
`
`mark “AIR-SOLE” for “Insoles for Articles of Footwear” in International Class 25, registered
`
`January 13, 1981. This Registration is incontestable pursuant to Section 15 of the Lanham Act,

`15 U.S.C. § 1065, and thus serves as conclusive evidence of the validity of Opposer’s “AIR-
`
`SOLE” mark pursuant to 15 U.S.C. § 1115(b).

`Opposer is the owner of U.S. Trademark Registration Nos. 1,284,386 and
`
`1,571,066 for the mark
`
` for “Footwear” and “Clothing, namely T-shirts” in
`
`International Class 25, registered July 3, 1984 (U.S. Reg. No. 1,284,386) and December 12, 1989
`
`(U.S. Reg. No. 1,571,066). These Registrations are incontestable pursuant to Section 15 of the
`
`Lanham Act, 15 U.S.C. § 1065, and thus serve as conclusive evidence of the validity of Opposer’s
`
`mark pursuant to 15 U.S.C. § 1115(b).
`

`Opposer is the owner of U.S. Trademark Registration No. 1,307,123 for the word
`
`mark “NIKE AIR” for “Footwear and Cushioning Elements for Footwear Soles” in International
`
`Class 25, registered November 27, 1984. This Registration is incontestable pursuant to Section 15
`
`of the Lanham Act, 15 U.S.C. § 1065, and thus serves as conclusive evidence of the validity of
`
`Opposer’s “NIKE AIR” mark pursuant to 15 U.S.C. § 1115(b).
`

`
`Opposer is the owner of U.S. Trademark Registration No. 1,370,283 for the word
`
`mark “AIR JORDAN” for “Footwear and athletic clothing, namely, shirts, pants, shorts” in
`
`International Class 25, registered November 12, 1985. This Registration is incontestable pursuant
`
`to Section 15 of the Lanham Act, 15 U.S.C. § 1065, and thus serves as conclusive evidence of the
`
`validity of Opposer’s “AIR JORDAN” mark pursuant to 15 U.S.C. § 1115(b).
`
`14.
`
`Opposer is the owner of U.S. Trademark Registration No. 3,725,535 for the mark
`
`for “Footwear; Apparel, namely, shirts, pants, shorts; Jackets, hats; Sweatshirts”
`
`in International Class 25, registered December 15, 2019. This Registration is incontestable

`pursuant to Section 15 of the Lanham Act, 15 U.S.C. § 1065, and thus serves as conclusive

`evidence of the validity of Opposer’s mark pursuant to 15 U.S.C. § 1115(b).

`Opposer is the owner of U.S. Trademark Registration No. 1,508,348 for the word
`
`mark “AIR MAX” for “Footwear” in International Class 25, registered October 11, 1988. This
`
`Registration is incontestable pursuant to Section 15 of the Lanham Act, 15 U.S.C. § 1065, and thus
`
`serves as conclusive evidence of the validity of Opposer’s “AIR MAX” mark pursuant to 15 U.S.C.
`
`§ 1115(b).
`

`Opposer is the owner of U.S. Trademark Registration No. 1,686,515 for the word
`
`mark “AIR FLIGHT” for “Footwear” in International Class 25, registered May 12, 1992. This
`
`Registration is incontestable pursuant to Section 15 of the Lanham Act, 15 U.S.C. § 1065, and thus
`
`serves as conclusive evidence of the validity of Opposer’s “AIR FLIGHT” mark pursuant to 15
`
`U.S.C. § 1115(b).

`17.
`
`Opposer is the owner of U.S. Trademark Registration No. 1,789,463 for the word
`
`mark “AIR TRAINER MAX” for “Footwear” in International Class 25, registered August 24,
`
`1993. This Registration is incontestable pursuant to Section 15 of the Lanham Act, 15 U.S.C. §
`
`1065, and thus serves as conclusive evidence of the validity of Opposer’s “AIR TRAINER MAX”
`
`mark pursuant to 15 U.S.C. § 1115(b).
`
`18.
`
`Opposer is the owner of U.S. Trademark Registration No. 3,520,484 for the word
`
`mark “AIR FORCE I” for “Footwear” in International Class 25, registered October 21, 2008. This
`
`Registration is incontestable pursuant to Section 15 of the Lanham Act, 15 U.S.C. § 1065, and thus
`
`serves as conclusive evidence of the validity of Opposer’s “AIR FORCE I” mark pursuant to 15
`
`U.S.C. § 1115(b).

`Opposer is the owner of U.S. Trademark Registration No. 5,286,596 for the word
`
`mark “NIKE AIR VAPORMAX” for “Footwear” in International Class 25, registered September
`
`12, 2017.
`
`20. Opposer is the owner of pending U.S. Trademark Application No. 97/056,361
`
`(the “’361 Application”), filed on October 1, 2021, for the mark
`
` for “Footwear” in
`
`International Class 25. The application is based on use in commerce, with a claimed date of first
`
`use of the mark in commerce of 1996.
`

`Copies of the foregoing U.S. Trademark Registrations for the AIR Marks and AIR-
`
`Formative Marks, including the USPTO TSDR records showing the current status and title of the
`
`registrations and applications, are attached as Exhibit A.
`
`22.
`
`In addition to the registrations identified above, over the years, Opposer has owned
`
`other registrations for marks incorporating the word “AIR” in the United States.
`
`BACKGROUND ON APPLICANT AND HIS MARK
`
`23.
`
`Applicant filed Application Serial No. 90/659,215 (hereinafter “the ‘215
`
`Application”) for the mark “4IR” on April 20, 2021. The ‘215 Application was filed pursuant to
`
`Section 1(b) of the Trademark Act, claiming intended use of the mark in commerce in connection
`
`with “Shirts” in International Class 25.
`
`24.
`
`If Applicant is permitted to register the applied-for mark in the ‘215 Application,
`
`the registration will give Applicant a prima facie exclusive right to the use of “4IR” for the goods
`
`set forth in the application. Such registration would damage and injure Opposer.
`
`COUNT I
`
`LIKELIHOOD OF CONFUSION
`

`Opposer repeats and realleges paragraphs 1-24 as paragraph 25 of this Count I.

`Opposer’s use and registration of its AIR Marks and AIR-Formative Marks is long
`
`prior to the filing dates of the Applicant’s ‘215 Application.
`
`27.
`
`On information and belief, Applicant was aware of Opposer’s AIR Marks and AIR-
`
`Formative Marks at the time he filed his Application.
`
`28.
`
`Applicant’s “4IR” Mark is confusingly similar to Opposer’s AIR Marks and AIR-
`
`Formative Marks. Applicant’s mark is highly similar in sight and overall commercial impression
`
`to Opposer’s AIR and AIR-Formative Marks.
`
`29.
`
`The goods identified in Applicant’s ‘215 Application, specifically “Shirts,” are
`
`identical to the goods included in several of Opposer’s pleaded registrations and for which
`
`Opposer’s AIR Marks and AIR-Formative Marks are used in commerce.
`
`30.
`
`Due to at least the similarity of the marks and goods involved, and other factors,
`
`Applicant’s use and registration of “4IR” will inevitably lead to confusion, to mistake, or to
`
`deception of the public within the meaning of Section 2(d) of the Lanham Act, 15 USC § 1052(d),
`
`all to Opposer’s grave and irreparable damage.
`
`31.
`
`Registration of Applicant’s Mark in the ‘215 Application should be denied based
`
`on a likelihood of confusion with Opposer’s AIR Marks and AIR-Formative Marks, in violation
`
`of Section 2(d) of the Lanham Act, 15 USC § 1052(d).
`
`CLAIM FOR RELIEF/DAMAGE
`

`By reason of the foregoing, Applicant’s registration of “4IR” in the ‘215
`
`Application will cause injury and damage to Opposer’s prior rights to its AIR Marks and AIR-
`
`Formative marks and to its use thereof described above.
`
`WHEREFORE, Opposer respectfully prays that the present opposition be sustained and
`
`that the registration sought by Applicant be refused.
