`Conopco, Inc., a New York corporation, having a principal place of business at 700 Sylvan

`Avenue, Englewood Cliffs, New Jersey 07632 (hereinafter “Opposer”), believes that it will be

`damaged by the registration of the trademark “YOSICLE” shown in Application Serial No.
`
`97/033,114 (the “Application”). Opposer timely files this Notice of Opposition. As grounds for
`
`the opposition, Opposer alleges as follows:

`On information and belief, Bio Brands Inc. is a corporation organized under the
`
`laws of New York with a principal address of 4080 Ocean Avenue, Brooklyn, New York 11235
`
`(hereinafter, “Applicant”).
`

`
`Opposer provides frozen confections, water ices, sweets, ice creams and related
`
`goods throughout the world, including in the United States.
`
`3.
`
`Opposer is the owner and registrant of the marks CREAMSICLE, FUDGSICLE,
`
`POPSICLE, SICLE STACKER, and related variations of these marks, many of which are covered
`
`by incontestable United States registrations, which are valid registrations in full force and effect.
`
`The details of these registrations, as well as Opposer’s pending application for SICLE, filed

`Opposer has made, and continues to make, a substantial investment in advertising
`
`and promoting its goods under Opposer’s Marks.
`

`
`Applicant’s mark YOSICLE (“Applicant’s Mark”) and Opposer’s Marks are
`
`similar in sight, sound, meaning and overall commercial impression.
`
`7.
`
`Applicant’s goods as listed in the Application for “Bakery goods; Bakery products;
`
`Bakery products, namely, sweet bakery goods; Dessert mousse; Dessert puddings; Dessert
`
`souffles; Frozen yogurt; Ice cream; Pastries; Pastries with fruit; Bakery desserts; Bakery goods
`
`and dessert items, namely, cakes, cookies, pastries, candies, and frozen confections for retail and
`
`

`wholesale distribution and consumption on or off the premises; Bakery goods and dessert items,
`
`namely, cheesecakes for retail and wholesale distribution and consumption on or off the premises;
`
`Danish pastries; Ice cream desserts; Toaster pastries” in class 30 cover the goods offered by
`
`Opposer under Opposer’s Marks and/or are highly related thereto.
`

`The classes of purchasers are the same with respect to Opposer’s goods and
`
`Applicant’s goods.
`
`9.
`
`Applicant’s goods offered under the YOSICLE mark travel in the same trade
`
`channels as the goods offered under Opposer’s Marks.
`
`10. When used in connection with the goods listed in the Application, Applicant’s Mark
`
`is likely to cause confusion, or to cause mistake, or to deceive, within the meaning of Section 2(d)
`
`of the Lanham Act, 25 U.S.C. § 1052(d).
`

`The relevant consuming public is likely to mistakenly believe that Applicant’s
`
`goods originate from, are sponsored or authorized by, or are otherwise connected to Opposer’s
`
`goods.

`Applicant filed the Application on September 17, 2021, on an intent to use basis.
`
`The filing date of the Application comes over 75 years after Opposer’s earliest use
`
`of Opposer’s Marks in the United States.

`Opposer’s Marks are senior to Applicant’s Mark.
`
`Based upon the foregoing, the registration of Applicant’s Mark is likely to cause

`injury and damage to the Opposer.

`shown by Application Serial No. 97/033,144 be denied under Section 2(d) of the Lanham Act, 15
