`Guangzhou Boyunlong Trading Co., Ltd. ("Applicant"), a company located at Rm. A3473,

`Bldg. A, No. 7 and 9, Tangdong Hengling 2nd Rd., Tianhe Dist., Guangzhou, Guangdong

`CHINA 510645 in Application Serial No. 97434897 (the "Application"). Opposer hereby

`opposes the registration of Applicant's Mark pursuant to 15 U.S.C. §§ 1051 et seq.,

`3. Opposeris the owner of Trademark Application No. 97451853 for the use of Opposer's

`Mark, "BOOYU"in classes 012 ("Opposer's Application") , which was filed on June 09,
`
`2022, and claimedfirst use in commerce from September 03, 2021, and a true copy from
`
`the USPTO TSDRis attached hereto as Exhibit B. Opposer has used "BOOYU"as a
`
`trademark since 2021, while Applicantfiled the mark claimingintent to use.
`
`4. Opposer's Mark is specially designed, and the letter BOOYU shares the same
`
`pronunciation as "#f1 =" (bé yt), which is the short name of Foshan Boyu E-Commerce
`
`Co., Ltd.. BOOYUis also a fanciful and arbitrary word, which has no descriptive meaning
`
`as applied to a marketplace or to any of the goods and services covered by the Opposer's
`
`Application or in connection with which it uses Opposer's Mark;

`products in class 012 but also in class 011 like car lights related. The products like
`"Vehicle Horns" with ASIN-BO9FFVVFNZ on Amazon got reviews on December 24,
`
`2021. Besides, by searching BOOYU on Google,there is only the brand information from
`
`the Opposer’s Amazonstore andselling links (hereto as Exhibit E). As a result, Opposer
`believes that the Applicant should know that Opposer is the trademark right owner of
`BOOYU brand and puts great efforts into promoting BOOYUbrandrelated to goods in
`
`class 012.

`forth in the Application, which are related, if not identical, to Opposer's Goods. Opposer

`has no control over the nature and quality of the goods and services offered by Applicant

`under the confusingly similar Applicant's Mark, and Opposer's reputation and goodwill

`will be damaged and the value of Opposer's Mark jeopardized by Applicant's registration
`
`and use of Applicant's Mark.

`9. Applicant's use and registration of Applicant's Mark for Applicant's Goods is likely to
`
`dilute the distinctive quality of Opposer's Mark within the meaning of Section 43(c) of the
`
`Trademark Act, 15 U.S.C. § 1125(c).

`10. If Applicant's Mark is allowed to register, Opposer will be damaged by the
`
`registration.

`il. In summary, registration of the proposed mark would be incorrect and improper in

`view of the requirements of the Trademark Act of 1946, as amended,
