` Opposer, Trek Bicycle Corporation (“Opposer”), a Wisconsin

`damaged by registration of the TREKASSY and Design mark in
`
`Serial No. 97/546,107 and hereby opposes the same, in accordance
`
`with Section 13 of The Trademark (Lanham) Act of 1946, 15 U.S.C.
`
`§1063.
`
` As grounds for the opposition, Opposer alleges as follows:
`
`1. Upon information and belief, Shenzhen Jiadefu
`
`Technology Co., Ltd.(“Applicant”) is a limited company organized
`
`under the laws of China with a principal place of business of Rm
`
`1802, Bldg 6, PhaseII, Runyuan, Happy City, Longhuan 3rd Rd,
`
`Longhua St, Longhua Dist, Shenzhen, China 517000.

`2. As evidenced by the publication of Serial No.
`
`97/546,107 in the Official Gazette of July 11, 2023, Applicant
`
`seeks to register TREKASSY and Design (the “Opposed Mark”) in
`
`connection with “Swings; Exercising equipment, namely, rowing
`
`machines; Floating recreational lounge chairs; Horizontal bars;
`
`Manually-operated exercise equipment for physical fitness
`
`purposes; Parallel bars; Playground slides; Rocking horses;
`
`Skipping ropes; Smart robot toys; Swing sets; Toy construction
`
`blocks; Video game machines” in Class 28.
`
`
`
`3. Upon information and belief, Applicant filed Serial No.
`
`97/546,107 on August 12, 2022, based on use of the Opposed Mark
`
`in commerce in connection with the claimed goods in Class 28,
`
`claiming date of first use ever and date of first use in
`
`commerce of October 27, 2018.
`
`4. For nearly 42 years prior to the claimed date of first
`
`use of the Opposed Mark, Opposer adopted and has continuously
`
`used the trade name "TREK" in connection with its business
`
`activities.
`
`
`
`5. Opposer has invested substantial amounts of time,
`
`effort and money in protecting and policing its TREK trade name
`
`in the United States and throughout the world. As such, Opposer
`
`has extensive, non-registered statutory and common law rights in
`
`and to its TREK trade name, which Opposer uses in connection
`
`with its business activities.

`6. For nearly 41 years prior to the claimed date of first
`
`use of the Opposed Mark, Opposer adopted and has continuously
`
`used its TREK trademark in connection with bicycles and bicycle
`
`frames.
`
`7. Opposer has expanded its trademark use of "TREK" to
`
`cover numerous additional products and services, including but
`
`not limited to, exercise equipment, namely, stationary trainers
`
`for use with bicycles.
`
`8. Opposer is the owner of the following U.S. trademark
`
`registrations:
`
`Registration No. 1,168,276 for TREK for "bicycles and
`bicycle frames" in Class 12 (see Exhibit A);
`
`Registration No. 1,989,281 for TREKKING for "bicycles" in
`Class 12 (see Exhibit B);
`
`Registration No. 1,994,479 for TREK 100 for "providing ride
`support vehicles in competitive and recreational events,
`namely, bicycle tours, bicycle races, and triathlons" in
`Class 39 (see Exhibit C);
`
`Registration No. 2,060,274 for TREK for "cycling computers
`and head protective helmets for bicycle users" in Class 9
`and “bicycles, bicycle frames, and a full line of parts and
`accessories for bicycles, namely, handlebars, seats, seat
`posts, seat post clamps and binder bolts, forks for
`supporting bicycles upon bicycle wheels, water bottles,
`water bottle cages, bicycle mounted racks, tools and tire
`repair kits for bicycles, lock holders, lighting systems
`for bicycles” in Class 12(see Exhibit D);

`Registration No. 2,687,012 for ETREK for "online retail and
`wholesale store services, featuring a wide range of
`consumer products, except footwear, all provided via the
`Internet" in Class 35 (see Exhibit E);
