`Hasbro, Inc. (“Hasbro”), a Rhode Island corporation having a principal place of business

`at 1027 Newport Avenue, Pawtucket, Rhode Island 02862, believes that it will be damaged by
`
`registration of the subject mark of U.S. Trademark Application Serial No. 97/394,969 (the
`
`“Challenged Application”) for SUPER JOE (“Applicants’ Mark”) and hereby opposes that
`
`application. The owners of record of the Challenged Application are Mr. Jason Schiermeyer and
`
`Mr. Steve Stovall (“Applicants”), individuals each having an address of 1804 Nixon Avenue NE,
`
`Huntsville, Alabama 35811.
`
`The grounds for opposition are as follows:
`

`Hasbro is a leading toy and game manufacturer, and has been engaged for decades
`
`in the creation, manufacture and sale of toys and games, television programming, motion
`
`pictures, and digital gaming, and runs a comprehensive licensing program.
`

`From toys and games to television, movies, digital gaming and consumer
`
`
`

`products, Hasbro offers a variety of ways for audiences to experience its iconic brands, including
`
`G.I. JOE, EASY-BAKE, MONOPOLY, MAGIC: THE GATHERING, NERF, MY LITTLE
`
`PONY, TRANSFORMERS, PLAY-DOH, BABY ALIVE, DUNGEONS & DRAGONS,
`
`POWER RANGERS, PEPPA PIG and PJ MASKS, as well as premier partner brands that
`
`include some of the world’s largest and well-known entertainment brands.

`Hasbro is recognized as a leader in its industry and as a corporate citizen. For
`
`example, for more than a decade, Hasbro has been consistently recognized for its corporate
`
`citizenship, including being named one of the 100 Best Corporate Citizens by 3BL Media, one of
`
`the World’s Most Ethical Companies by Ethisphere Institute, and one of the 50 Most
`
`Community-Minded Companies in the U.S. by the Civic 50.

`For more than fifty-eight (58) years, Hasbro, its predecessors in interest, and its
`
`licensees have used the trademark G.I. JOE, and marks associated with G.I. JOE, including, but
`
`not limited to, SUPER JOE, for toy action figures and related accessories, books, comic books,
`
`multimedia productions and a variety of related goods and services (the “G.I. JOE Marks”).

`Hasbro sold an action figure line in the late 1970s under the trademark SUPER
`
`JOE.

`5,484,953 are incontestable within the meaning of 15 U.S.C. §§ 1115(b) and 1065. Those
`
`registrations are conclusive evidence of the validity of the subject marks thereof, the registrations

`therefor, and of Hasbro’s exclusive right to use those marks in connection with the goods set

`forth therein.

`Registration No. 6,853,143 constitutes prima facie evidence of the validity of the
`
`subject marks thereof, the registrations therefor, and of Hasbro’s exclusive right to use those
`
`marks in connection with the goods set forth in that registration.
`

`
`Beginning on or about October 4, 1976, Hasbro used the trademark SUPER JOE
`
`for toy dolls, action figures, related accessories and merchandise associated with its G.I. JOE line
`
`of products, and its SUPER JOE mark was the subject of U.S. Registration No. 1,099,679 for
`
`“toy doll and accessories therefor.”
`

`
`Since its adoption and first use of the G.I. JOE trademark in 1963, Hasbro has
`
`devoted, and continues to devote, substantial time, money and effort in promoting its G.I. JOE
`
`Marks to identify Hasbro as the source of the goods.
`
`11.
`
`In the past several decades, Hasbro has sold hundreds of millions of dollars of
`
`G.I. JOE products, and Hasbro’s advertising and promotion costs for the brand have been in
`
`excess of $100 million.
`
`12.
`
`Through the years, the G.I. JOE brand has grown tremendously and expanded into
`
`various industries, including animation, comic books and film.
`
`13.
`
`The G.I. JOE brand has been the subject of widespread domestic and international
`
`media coverage throughout the past fifty-eight (58) years, including during its 50th anniversary
`
`year in 2014.
`

`
`Time Magazine named the G.I. JOE action figure one of the Top 100 Toys of All
`
`Time (see

`By virtue of Hasbro’s longstanding use, enormous sales and advertising

`expenditures, third party awards and unsolicited media coverage, the G.I. JOE Marks have
`
`developed substantial and valuable goodwill that belongs exclusively to Hasbro.

`Hasbro’s G.I. JOE word mark has become famous and is widely recognized by
`
`the general consuming public of the United States as a designation of the source of Hasbro’s
`
`action figures.

`Hasbro is entitled to a broad scope of protection for its G.I. JOE Marks.
`
`21.
`
`On May 4, 2022, Applicants filed U.S. Trademark Application Ser. No.
`
`97/394,969 for the mark SUPER JOE.
`
`22.
`
`The Challenged Application is based on intent to use and covers: “action figures”
`
`in Class 28 and “on-line retail store services featuring action figures, comic books, drinkware,
`
`pins” in Class 35.
`
`23.
`
`Applicants’ Mark is identical to Hasbro’s SUPER JOE word mark in sight, sound,
`
`meaning and commercial impression.
`
`24.
`
`Applicants’ Mark is identical or closely similar to Hasbro’s G.I. JOE Marks in
`
`sight, sound, meaning and commercial impression.

`to create a likelihood of confusion under the circumstances described herein.

`Hasbro believes that it will be damaged by the registration of Applicants’ Mark

`because such registration would support and assist Applicants in the confusing and misleading
`
`use of the designation it seeks to register, and would give color of exclusive statutory rights to

`Applicants, in violation and derogation of the prior and superior rights of Hasbro.

`on the basis of priority and likelihood of confusion, and dilution, and that the Trademark Trial

`and Appeal Board grant such other relief as it deems just and proper.
