`Panda Life Ltd. (“Opposer”), a limited liability company duly organized and existing under

`the laws of the United Kingdom, located and doing business at Unit 26, Garrick Industrial Estate,
`
`Irving Way, London, NW9 6AQ, United Kingdom, believing that it will be damaged by
`
`registration, pursuant to 15 U.S.C. § 1063(a), hereby opposes Application Serial No. 97/858,661
`
`(“the ‘661 Application”) for the mark PANDAKLEEN (the applied-for “PANDAKLEEN mark”),
`
`filed on March 27, 2023, under the Trademark Act of 1946, published for opposition in the Official
`
`Gazette of January 30, 2024, in the name of M AND M TYH LLC (“Applicant”).

`The grounds for this Opposition are as follows:

`Opposer’s PANDA-formative Marks

`Prior to Applicant’s filing date, Opposer engaged—and continues to engage—in
`
`the advertising, promotion, sale, and offering for sale in interstate commerce of goods including
`

`Prior to Applicant’s filing date, Opposer used, and is now using, Opposer’s

`PANDA-formative marks in connection with Opposer’s goods, including bed and bath products,

`that are advertised, promoted, sold, and/or rendered by Opposer in commerce. Opposer’s
`
`PANDA-formative marks include, but are not limited to: PANDA, PANDA LIFE, PANDA
`
`LONDON,

`Opposer’s PANDA-formative marks have been in use, including within United
`
`States interstate commerce, since at least as early as April 2015 in connection with bed products,
`
`including but not limited to pillows. (See Exhibits A, B).

`Opposer’s PANDA-formative marks have been in use, including within United
`
`States interstate commerce, since at least as early as January 2020 in connection with bath
`
`products, including but not limited to towels, bath rugs, and hooded towels.

`Opposer has sold and offered for sale, and is selling and offering for sale, bed and
`
`bath goods, including memory foam bamboo pillows and mattress toppers, using PANDA-
`
`formative marks online, including selling or offering to sell within the United States. Attached as

`Exhibit C are examples of Opposer’s use of PANDA-formative marks online at Etsy.com.

`subsisting, and are prima facie evidence of Opposer’s exclusive right to use the PANDA LIFE and
`
`PANDA LONDON marks in commerce in connection with the goods specified in the registration.

`Opposer’s U.S. Registration No. 4,833,551 for PANDA LIFE is incontestable
`
`under Section 15 of the Lanham Act, 15 U.S.C. § 1065, is conclusive evidence of the validity of
`
`the registered mark, the registration, Opposer’s ownership of the PANDA LIFE Mark, and
`
`Opposer’s exclusive right to use the PANDA LIFE Mark in commerce under Section 33 of the
`
`Lanham Act, 15 U.S.C. § 1115.

`Since its initial use, Opposer has advertised, promoted, offered, and sold Opposer’s
`
`goods in connection with PANDA-formative marks to the public through channels of trade in
`
`commerce, with the result that Opposer’s customers and the relevant purchasing public in general
`
`have come to know and recognize Opposer’s PANDA-formative marks and associate the same
`
`with Opposer and/or the goods promoted, offered, and sold by Opposer. Opposer has invested in
`
`the advertising and promoting of its goods under its PANDA-formative marks.
`
`10.
`
`Opposer has goodwill in connection with the sale of its goods in connection with
`
`the PANDA-formative marks.
`
`Applicant’s Applied-for Mark and Application
`
`11.
`
`Upon information and belief, Applicant is a New Jersey limited liability company
`
`located at 374 Grande River Blvd, Toms River, New Jersey 08755 United States.
`
`12.
`
`The prosecution history for the ‘661 Application shows that, on March 27, 2023,
`
`Applicant filed an application under Trademark Act Section 1(b) for registration of the applied-
`
`for PANDAKLEEN mark.
`
`13.
`
`The ‘661 Application was published for Opposition in the Trademarks Official
`
`Gazette on January 30, 2024 at p. TM 2668.
`
`14.
`
`As published for Opposition, the goods recited in the ‘661 Application are:
`
`Class 24: Towels
`
`(“Applicant’s Goods”). The ‘661 Application’s file history is attached as Exhibit G.

`GROUNDS OF OPPOSITION
`COUNT I - PRIORITY AND LIKELIHOOD OF CONFUSION

`15.
`
`Opposer repeats, re-alleges and incorporates by reference paragraphs 1-14 above.
`
`16.
`
`Opposer owns valid and subsisting rights in the PANDA-formative Marks, each of
`
`which has been in use since prior to Applicant’s filing date.
`
`17.
`
`Applicant’s applied-for PANDAKLEEN mark is a simulation and colorable
`
`imitation of, and so resembles Opposer’s registered and common law PANDA-formative Marks.
`
`18.
`
`Applicant’s goods under Class 24 are identical and/or related to the goods sold in
`
`connection with Opposer’s PANDA-formative Marks.
`
`19.
`
`Upon information and belief, Opposer’s and Applicant’s goods will be sold through
`
`online retail channels and target the same general class of purchasers.
`
`20.
`
`Opposer avers that members of the relevant purchasing public are likely to be
`
`confused, mistaken or deceived as to the origin and sponsorship of Applicant’s goods and misled
`
`into believing that such goods are produced and/or rendered by, emanate from, or are in some way
`
`associated with Opposer, to the damage and detriment of Opposer and its reputation in violation
`
`of Trademark Act Section 2(d), 15 U.S.C. § 1052(d).

`Opposer avers that it will be damaged by registration of the applied-for
`
`PANDAKLEEN mark, as set forth in the ‘661 Application, in that the mark is confusingly similar
`
`to Opposer’s registered and common law PANDA-formative Marks and will be used in connection
`
`with goods identical and/or related to the goods offered by Opposer.

`I gott this pillow a long time ago. Costco has the hook up when they have them
`for sell. I can say this like with any pillow as you sleep on it, the pillow will
`compress. This pillow will get flat. What I have done when it gets like this is wash
`the pillow. There is kinda a trick when washing tho. I have a front load washer so
`you cant just throw this pillow in all by itself. Your tear up your washer and it will
`be full of water. You have to wash it with a comforter to take up all that space.
`Then max extraction on water is also a must. I also use Downey- I use a lot cause
`I like the smell. If you find your neck hurting wash that pillow and see if that will
`help you. It brings back the love in the pillow for me.

`Just started using these pillows for my husband and self and we both really like it. Having owned a B&B previously, we are "bedding" savvy and this is one of the most
`comfortable pillows out there. Side sleeper, back sleeper ... think it would be good for anyone. It does help keep your head cooler at night and helps with snoring issues. Good
`support for head/neck and good night's sleep. Purchased these at Costco at a special demo display, 2 for basically the price of one. I hope it holds up well but nothing but
`compliments about this pillow.

`I truly have "issues" when it comes to pillows. I have searched for years for the right pillow. I know it all sounds a little dramatic, but it's true. Panda Life had a display set up at
`our local Costco. I figured what the heck, I can always return it. I bought 2 king pillows for what they are priced for one here on Amazon. Crazy comfortable! I am a side sleeper,
`but I also read a lot in bed. Recent surgery relieved most of my pain, but I was still waking up in the morning with neck stiffness. The panda pillow has resolved that problem.
`Hard to explain. At first the pillow seems as though it is too firm, but after a minute or so it forms to your neck and shoulders and sort of cradles the head. Very supportive.
`After a week of use I find that I'm not tossing and turning as much. We travel between two homes. I decided I needed another pillow for the second home and assumed that
`Costco carried them. Wrong! I can't find the panda brand at any retail stores. I went out and bought the Miracle Bamboo pillow at BB&B. Looks the same, but not even close. It
`does not contour like the Panda and it stinks. The Miracle pillow even comes with a paper that says the odor May last up to a week! The Panda had no smell whatsoever. $60 for
`a single pillow seems ridiculous, but to me it's worth every penny. High quality and comfort all in one.
