`Panasonic Corporation of North America ("PNA"), a Delaware corporation, with offices

`at Two Riverfront Plaza, Newark, New Jersey 07102-5490, believes that it will be damaged by
`
`registration of the mark WHISPER AERO, Serial No. 90/626,264, filed on April 6, 2021, by
`
`Whisper Aero Inc. (“Whisper Aero”), a Delaware corporation with a place of business at 109
`
`Pointe Landing, Crossville, Tennessee 38555. PNA hereby opposes registration of the
`
`WHISPER AERO mark with respect to International Classes 7 and 11 on the following grounds:

`Since at least as early as 2007, PNA has adopted and used a family of WHISPER
`
`marks, including but not limited to WHISPER CONTROL, WHISPER THIN,
`
`WHISPERWARM, WHISPERFIT, WHISPER MIGHTY, WHISPER CHOICE, WHISPER
`
`REMODEL, WHISPERLINE among others, and it has expressed an intent to use additional
`
`WHISPER marks, including but not limited to WHISPER SLIM, WHISPER COZY, and
`
`WHISPER RENEW (collectively, the PNA WHISPER Marks).

`The PNA WHISPER Marks are used (or are intended for use) in United States

`commerce in connection with electric fans and/or related goods and services.

`PNA consistently and prominently displays the PNA WHISPER Marks in

`connection with the advertising, promotion and sale of its goods and services. PNA uses the
`
`PNA WHISPER Marks extensively on PNA products and in advertising and promotional
`
`materials, both online and in print.

`As a result of PNA’s extensive and long-standing use of the PNA WHISPER
`

`for PNA WHISPER Marks attached as Exhibit A.

`By reason of extensive advertising and sale, the PNA WHISPER Marks have
`
`become, through widespread and favorable public acceptance and recognition, an asset of
`
`incalculable value as a symbol of PNA, its quality products and services, and its goodwill.

`Long after PNA first used the PNA WHISPER Marks, and after the USPTO
`
`issued federal registrations for many of the PNA WHISPER Marks, and after the PNA
`
`WHISPER Marks became well known, Whisper Aero applied to register the WHISPER AERO
`
`mark with the USPTO.

`At the time Whisper Aero filed the application for the WHISPER AERO mark, it
`
`had constructive knowledge of PNA’s rights in its PNA WHISPER Marks, and, upon
`
`information and belief, had actual knowledge of the PNA WHISPER Marks.

`10. Whisper Aero’s WHISPER AERO mark is confusingly similar in sight, sound,
`
`and commercial impression to PNA’s PNA WHISPER Marks.

`The goods offered under the PNA WHISPER Marks with respect to International
`
`Classes 7 and 11 are highly related to the goods recited in Whisper Aero’s application for the

`WHISPER AERO mark.

`PNA did not authorize Whisper Aero’s adoption and use of the WHISPER AERO

`mark.

`relevant trade and public under Section 2(d) of the Trademark Act. Consumers will likely
`
`believe that Whisper Aero’s goods are in some way associated with or connected with, or
`
`approved or authorized by, PNA, when this is not the case.

`By reason of the foregoing, PNA believes that it will be damaged by registration
`
`of Whisper Aero’s WHISPER AERO mark in connection with the applied-for goods in

`International Classes 7 and 11.

`WHEREFORE, PNA prays that this Opposition be sustained and that Application Serial
