`Google LLC (“Opposer”) believes that it will be damaged by the registration of the mark

`(the “PIXELMAX Mark”), covered by Application Serial No. 79333016 filed on
`May 20, 2021 (the “Application”), and hereby opposes the Application. As grounds for this opposition,
`Opposer alleges as follows:

`THE PARTIES
`Opposer is a limited liability company organized under the laws of Delaware, with an

`Upon information and belief, Imagin3D Ltd (“Applicant”) is a United Kingdom limited
`company (ltd.), with an address of DSG Accountants, Castle Chambers, 43 Castle Street Liverpool L2
`9TL United Kingdom.

`OPPOSER’S MARK
`Opposer is a provider of Internet search services, email and productivity software, mobile

`hardware products, and other related software, hardware, and services.

`Among its products and services, Opposer offers a range of mobile hardware products and
`software for use with such products (collectively, “Opposer’s Offerings”) under the PIXEL mark (the
`“PIXEL Mark”).

`On February 21, 2013, Opposer launched the CHROMEBOOK PIXEL, its first
`touchscreen-enabled laptop, and the PIXEL Mark has been in continuous use ever since. In 2015, the
`second version of the CHROMEBOOK PIXEL was launched, and Opposer expanded its PIXEL brand to
`include the PIXEL C tablet device. In October 2016, Opposer launched two PIXEL smartphones, and in
`the years since, Opposer has continued to expand its PIXEL brand with the additions of new PIXEL

`smartphones (most recently launched PIXEL 8 and PIXEL FOLD), tablets (PIXEL TABLET),
`smartwatches (PIXEL WATCH), earbuds (PIXEL BUDS), and related accessories including wireless
`chargers (PIXEL STAND). Most of these products contain embedded operating software.

`Since at least as early as 2013 (“Opposer’s First-Use Date”), Opposer has continuously
`used, and presently uses, the PIXEL Mark and/or other PIXEL-formative marks in interstate commerce
`throughout the United States in connection with Opposer’s Offerings.

`Opposer owns many trademark filings for the PIXEL Mark and other PIXEL-formative
`marks covering Opposer’s Offerings, and Opposer is the owner of all goodwill represented thereby.

`APPLICANT AND APPLICANT’S MARK
`Applicant is the record owner of the Application, which was filed on May 20, 2021

`(“Applicant’s Filing Date”) based on Section 66(a) of the Lanham Act, 15 U.S.C. § 1141f.

`The Application covers the PIXELMAX Mark.

`Applicant’s PIXELMAX Mark is confusingly and deceptively similar to Opposer’s
`PIXEL Mark, such that the trade and purchasing public are likely to be confused, mistaken, and deceived
`into believing that Applicant’s Goods originate from or are otherwise authorized by, sponsored by,
`licensed from, or associated with, Opposer.

`Any defect, objection, or fault with Applicant’s Goods marketed or sold under
`Applicant’s PIXELMAX Mark will reflect upon and seriously injure the valuable reputation and
`goodwill that Opposer has established in Opposer’s PIXEL Mark.

`REQUEST FOR RELIEF

`WHEREFORE, Opposer respectfully requests that this Opposition be sustained, and that the
`Application be refused registration for Applicant’s Goods.
