`The parties have reached a settlement of this dispute. Prior to the settlement of this
`
`proceeding, PetSmart SSGI was the owner of the registration (Reg. No. 2,378,988) by
`
`assignment from PetSmart, Inc., executed on July 21, 2003. PetSmart, Inc. became the owner
`

`of the registration when PetSmart.com, Inc. was merged into PetSmart, Inc. on February 2,
`
`2003. PetSmart.com, Inc. was the prior owner of the registration by assignment from Digital
`
`Communities, Inc., effective as of October 6, 1999.
`
`As part of the settlement of this dispute, PetSmart SGGI has assigned its rights to the
`
`ACMEPET trademark and its ownership interest in the corresponding trademark registration
`
`(Reg. No. 2,378,988) to American Stores Company. All above-referenced assignments have
`
`been attached hereto as Exhibit A.
`
`In regards to Digital Communities, Inc., this entity has not yet filed an Answer in the
`
`pending cancellation. Therefore, pursuant to 37 C.F.R. § 2.114(c), the approval of Digital
`
`Communities, Inc.
`
`is not necessary in order to dismiss the cancellation proceeding without
`
`prejudice.
`
`Nevertheless, the dismissal of this proceeding is conditioned upon the Board's agreement
`
`with the understanding of the Petitioners, PetSmart.com, Inc., PetSmart, Inc. and PetSmart
`
`SSGI that this cancellation can indeed be dismissed without prejudice without the approval of
`
