`Wells’ Dairy, Inc. (hereinafter referred to as "Petitioner"), an Iowa corporation, having an
`
`address of PO Box 1310, One Blue Bunny Drive, Le Mars, Iowa 51031, believes that it will be
`
`damaged by Registration No. 3,166,541 issued October 31, 2006 to Manhattan Confectioners
`
`Inc. ("hereinafter referred to as "Respondent"), having an address of 2530 W. 237 Street,
`
`Torrance, California 90505, and hereby petitions to cancel the same. Petitioner respectfully
`
`requests the Board make this registration of record for purposes of this proceeding pursuant to 37
`
`C.F.R. § 2.122(d)(1).
`
`The grounds for cancellation are as follows:
`
`1.
`
`Petitioner has used the trademark GOOEY CHEWY TURTLE BROWNIE since
`
`December 26, 2002, and is now using this trademark for frozen confection products.
`

`Petitioner has filed an application to federally register the GOOEY CHEWY
`
`TURTLE BROWNIE trademark for frozen confection in Class 30, Serial No. 78/670,433 filed
`
`July 14, 2005.
`
`3.
`
`The Patent and Trademark Office by Office Action dated February 21, 2007, a
`
`copy of which is attached as Exhibit "A", has refused registration of Petitioner's mark GOOEY
`
`CHEWY TURTLE BROWNIE, Serial No. 78/670,433, under Trademark Act Section 2(d), 15
`
`U.S.C. § l052(d) because the Petitioner's mark, when used on or in connection with the
`
`identified goods, so resembles the mark in Registrant's U.S. registration 3,166,541 as to be likely
`
`to cause confusion, to cause mistake, or to deceive.
`

`Registrant has claimed in its registration 3,166,541 a date of first use of March 29,
`
`2005 for candy in Class 30.
`
`5.
`
`Petitioner, on the basis of its first use of its GOOEY CHEWY TURTLE
`
`BROWNIE trademark on December 26, 2002, has priority of use over Registrant claiming first
`
`use of its GOOEY CHEWY trademark on March 29, 2005.
`

`
`Registrant's registration 3,166,541 is blocking Petitioner's application, Serial No.
`
`78/670,433.
`

`Because of the nature of the respective parties‘ goods and the similarity between
`
`their respective marks, Registrant's mark GOOEY CHEWY is likely to cause confusion, mistake,
`
`or deception with Petitioner's previously used GOOEY CHEWY TURTLE BROWNIE
`
`trademark in the marketing of frozen confection and candy products.
`

`Moreover, Petitioner has investigated the status of Registrant and its use of the
`
`trademark GOOEY CHEWY for candy and has been unsuccessful in finding any evidence of
`
`current use.
`

`Registrant's registration 3,166,541 will result in damage to Petitioner under the
`
`provisions of Section 2(d) of the U.S. Trademark Act, 15 U.S.C. § 1052(d) pursuant to the
`
`allegations stated above.
`

`As further grounds for this cancellation action, Registrant has abandoned the
`
`registered mark.
`
`WHEREFORE, Petitioner requests that registration 3,166,541 be canceled and this
`
`cancellation action be sustained.
`
`Attached to this Petition to Cancel is the filing fee of $300.00, as required by CFR § 2.6.

`On August 4, 2006, action on this application was suspended pending the disposition of Application
`Serial No. 78601028. The referenced pending application has since registered. Therefore, registration is
`now refused under Trademark Act Section 2(d) as follows.

`Registration of the proposed mark is refused because of a likelihood of confiision with the mark in U.S.
`Registration No. 3166541. Trademark Act Section 2(d), 15 U.S.C. §1052(d); TMEP §§1207.01 et seq.
`See the enclosed registration.
`A likelihood of confusion determination requires a two-part analysis. First the marks are compared for
`similarities in appearance, sound, connotation and commercial impression. In re E. I. DuPont de
`Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973). Second, the goods or services are
`compared to determine whether they are similar or related or whether the activities surrounding their
`marketing are such that confusion as to origin is likely. In re August Storck KG, 218 USPQ 823 (TTAB
`1983); In re Int '1 Tel. and Tel. Corp., 197 USPQ 910 (TTAB 1978); Guardian Prods. Co., v. Scott
`Paper Co., 200 USPQ 738 (TTAB 1978); TMEP §§1207.0l et seq.
`1.
`Similarity of the Marks
`The applicant has applied to register the mark GOOEY CHEWY TURTLE BROWNIE.
`The mark in U.S. Registration No. 3166541 is GOOEY CHEWY.
`Marks may be confusingly similar in appearance where there are similar terms or phrases or similar
`parts of terms or phrases appearing in both applicant’s and registrant’s mark. See e.g., Crocker Nat 'l
`Bank v. Canadian Imperial Bank of Commerce, 228 USPQ 689 (TTAB 1986), afi”’d 1 USPQ2d 1813
`(Fed. Cir. 1987) (COMMCASH and COMMUNICASH); In re Phillz'ps- Van Heusen Corp., 228 USPQ
`949 (TTAB 1986) (21 CLUB and “21” CLUB (stylized)); In re Corning Glass Works, 229 USPQ 65

`Applicant’s mark and the registrant’s mark share the wording “GOOEY CHEWY” as the first portions
`of their respective marks. Although applicant’s mark adds the term “TURTLE BROWNIE,” this
`inclusion does not obviate the likelihood of confusion. The mere addition of a term to a registered mark
`does not obviate the similarity between the marks nor does it overcome a likelihood of confiision under
`Section 2(d). In re Chatam International Inc., 380 F.3d 1340, 71 USPQ2d 1944 (Fed. Cir. 2004)
`(“GASPAR’S ALE and “JOSE GASPAR GOLD”); Coca-Cola Bottling Co. v. Joseph E. Seagram &
`Sons, Inc., 526 F.2d 556, 188 USPQ 105 (C.C.P.A. 1975) (“BENGAL” and “BENGAL LANCER”);
`Lilly Pulitzer, Inc. v. Lilli Ann Corp., 376 F.2d 324, 153 USPQ 406 (C.C.P.A. 1967) (“THE LILLY” and
`“LILLI ANN”); In re El Torito Rests. Inc., 9 USPQ2d 2002 (TTAB 1988) (“MACHO” and “MACHO
`COMBOS”); In re United States Shoe Corp., 229 USPQ 707 (TTAB 1985) (“CAREER IMAGE” and
`“CREST CAREER IMAGES”); In re Corning Glass Works, 229 USPQ 65 (TTAB 1985) (“CONFIRM”
`and “CONFIRMCELLS”); In re Riddle, 225 USPQ 630 (TTAB 1985) (“ACCUTUNE” and “RICHARD

`In the present case, applicant’s mark does not create a distinct commercial impression because it
`contains the same distinctive wording as registrant’s mark, i.e. “GOOEY CHEW Y ,” at the beginning of
`its mark. As a general rule, consumers are more inclined to focus on the first word, prefix or syllable in

`any trademark or service mark. See Palm Bay Imps., Inc. v. Veuve Clicquot Ponsardin Maison Fondee
`En I 772, 396 F. 3d 1369, 1372, 73 USPQ2d 1689, 1692 (Fed. Cir. 2005); see also Presto Prods., Inc. v.
`Nice-Pak Prods., Inc., 9 USPQ2d 1895, 1897 (TTAB 1988) (“it is often the first part of a mark which is
`most likely to be impressed upon the mind of a purchaser and remembered” when making purchasing
`decisions).
`
`Furthermore, the additional wording “TURTLE BROWNIE” in the applicant’s mark is a common,
`descriptive phrase in the context of applicant and registrant’s confectionery goods. Descriptive terms
`are generally incapable of functioning as source identifiers; therefore, the wording “TURTLE
`BROWNIE” does not distinguish applicant’s mark from the registrant’s mark in terms of source.
`
`II.
`
`Similarity of the Goods
`
`Applicant’s proposed mark is used in connection with “frozen confections”
`
`The mark in U.S. Registration No. 3166541 is used in connection with “candy.”
`
`The goods and/or services of the parties need not be identical or directly competitive to find a likelihood
`of confusion. Instead, they need only be related in some manner, or the conditions surrounding their
`marketing are such that they would be encountered by the same purchasers under circumstances that
`would give rise to the mistaken belief that the goods and/or services come from a common source. On-
`line Careline Inc. v. America Online Inc., 229 F.3d 1080, 56 USPQ2d 1471 (Fed. Cir. 2000); In re
`Martin 's Famous Pastry Shoppe, Inc., 748 F.2d 1565, 223 USPQ 1289 (Fed. Cir. 1984); In re Melville
`Corp., 18 USPQ2d 1386, 1388 (TTAB 1991); In re Corning Glass Works, 229 USPQ 65 (TTAB 1985);
`In re Rexel Inc., 223 USPQ 830 (TTAB 1984); Guardian Prods. Co., Inc. v. Scott Paper Co., 200 USPQ
`738 (TTAB 1978); In re Int '1 Tel. & Tel. Corp., 197 USPQ 910 (TTAB 1978); TMEP §1207.0l(a)(i).

`In this case, applicant’s mark and the registrant’s mark are used in connection with confections that are
`often marketed under the same trademark. Attached are copies of printouts from the USPTO X-Search
`database, which show third-party registrations of marks used in connection with the same or similar
`goods and/or services as those of applicant and registrant in this case. These printouts have probative
`value to the extent that they serve to suggest that the goods and/or services listed therein, namely “frozen
`confections” and “candy,” are of a kind that may emanate from a single source. See In re Infinity Broad.
`Corp., 60 USPQ2d 1214, 1217-1218 (TTAB 2001); In re Albert Trostel & Sons Co., 29 USPQ2d 1783,
`1785-86 (TTAB 1993); In re Mucky Duck Mustard Co., Inc., 6 USPQ2d 1467, 1470 at n.6 (TTAB
`1988)
`
`A consumer is likely to believe that applicant and registrants’ goods emanate from a common source and
`more specifically that applicant and registrant’s goods are part of a line of confections, using the
`wording “GOOEY CHEWY” to identify their source.
`
`III.
`
`Conclusion
`
`The similarities among the marks and the goods are so great as to create a likelihood of confusion
`among consumers that the applicant’s goods and the registrant’s goods emanate from a common source.
`The examining attorney must resolve any doubt regarding a likelihood of confission in favor of the
`registrant. In re Hyper Shoppes (Ohio), Inc., 837 F.2d 463, 6 USPQ2d 1025 (Fed. Cir. 1988).
`Therefore, the proposed mark, GOOEY CHEWY TURTLE BROWNIE, must be refused under
`Trademark Act Section 2(d) of the Trademark Act.
`
`Although the trademark examining attorney has refused registration, applicant may respond to the
`

`refusal to register by submitting evidence and arguments in support of registration. If applicant chooses
`to respond, it must also address the following.
`
`Re_q;1irement to Disclaim “CHEWEY TURTLE BROWNIE”
`
`The examining attomey’s requirement that applicant disclaim the wording “CHEWEY TURTLE
`BROWNIE” is continued and MAINTAINED. Trademark Act Section 6, 15 U.S.C. §1056; TMEP
`§§1213 and 1213.03(a).
`In the initial Office Action, the examining attorney required that applicant disclaim the phrase “CHEWY
`TURTLE BROWNIE” because the wording describes the main features of applicant’s goods.
`Specifically, the phrase informs consumers that applicant’s frozen confections (1) are in need of much
`chewing and (2) include turtle brownies as an ingredient or are made to taste like turtle brownies.
`Applicant’s specimen of record, as submitted July 27, 2005, describes applicant’s goods as “chewy
`brownie bites with caramel sauce and roasted pecans in vanilla ice cream.” See the enclosed copy of the
`specimen of record. See also the enclosed Internet evidence (captured February 21, 2007), which shows
`that ice cream and other frozen confections are ofien made in a “turtle brownie” flavor.
`In a response to Office Action, filed August 2, 2006, applicant provided a disclaimer of the terms
`I “CHEWY” and “BROWNIE,” but requested that the examining withdraw the requirement to disclaim
`the term “TURTLE.” In support of this request, applicant cited nine registered and/or published marks
`that use the word “TURTLE” in relation to Class 030 frozen confections and do not contain a disclaimer
`of the word “TURTLE.”
`The examining attorney has reviewed applicant’s arguments and evidence and finds it unpersuasive. In
`this case, the term “TURTLE BROWNIE” is unitary. The phrase refers to a specific type of brownie —
`i.e. a brownie made with nuts and caramel. See the Internet evidence submitted with the initial Office
`Action, dated February 2, 2006, which is incorporated herein by reference. Therefore, the phrase
`“TURTLE BROWNIE” has a descriptive meaning in relation to applicant’s frozen confections, i.e. that
`“turtle brownies” are used as an ingredient and/or the confections are made to taste like “turtle
`brownies.” Conversely, the registrations and published applications used by applicant as evidence do
`not use the term “TURTLE” in a descriptive manner — e.g. the frozen desserts in U.S. Registration No.
`2679049 are not using “TURTLE MOUNTAINS” as ingredients.
`Accordingly, the requirement for a disclaimer of the full wording “CHEWEY TURTLE BROWNIE” is
`maintained. The computerized printing format for the Office’s Trademark Official Gazette requires a
`standardized format for a disclaimer. TMEP §l2l3.08(a)(i). The following is the standard format used
`by the Office:
`No claim is made to the exclusive right to use “CHEWY TURTLE BROWNIE” apart
`from the mark as shown.
`See In re Owatonna Tool C0,, 231 USPQ 493 (Comm’r Pats. 1983).
`
`Dates of Use Inconsistent — Date of First Use Anywhere Later Than Date of First Use in
`Commerce
`
`The application specifies a date of first use of the mark in commerce that is earlier than the date of first
`use anywhere. However, this is not possible because use in commerce by definition includes use
`anywhere. TMEP §903.04.
`
`Therefore, applicant must (1) amend the dates of use to specify a date of first use anywhere that is not
`later than the date of first use in commerce, and (2) verify this amended date with an affidavit or signed
`declaration under 37 C.F.R. §2.20. 37 C.F.R. §2.71(c); TMEP §903.05.
