`Appeal Board (“Board”) to suspend the above—captioned cancellation proceeding pending the
`
`final disposition of a civil action between the parties.
`
`On April 20, 2012, Cornfort24-7 filed a Complaint in a civil action in the U.S. District
`
`Court for the Northern District of Illinois against 24/? Home Comfort Services, Civil Action No.
`
`1:12-cv-02943 (“Civil Action”)
`
`(Ex. 1). The Complaint alleges that 24;’? Home Comfort
`
`Services’ use of the 24/7 HOME COMFORT SERVICES mark infringes Comfort24-7’s rights in
`
`the COMFORT24-7 trademark, U.S. Trademark Registration No. 3,518,741 (“COMFORT24—7
`
`Trademark Registration”), constitutes unfair competition, deceptive business practices, deceptive
`
`trade practices, and consumer fraud.
`
`On July 28, 2012, 24!? Home Comfort Services filed an Amended Counterclaim in the
`
`above referenced Civil Action (Ex. 2). Count II of the Amended Counterelaim asks the District
`

`Court to cancel the COMFORTZ4-7 Trademark Registration because it is allegedly generic,

`merely descriptive, non—distinct and lacking secondary meaning, or is a combination of terms

`On July 31, 2012,
`
`24;’? Home Comfort Services
`
`initiated the above-captioned
`
`cancellation proceeding to request
`
`that
`
`the Board cancel
`
`the COMFORT24—7 Trademark
`
`Registration because the mark is allegedly generic, merely descriptive, non-distinct and lacking
`
`secondary meaning, or is a combination of terms generic, merely descriptive, non.-distinct and
`
`lacking secondary meaning.
`
`The pending Civil Action accordingly involves issues which are involved in this
`
`proceeding, namely whether any trademark right owned by Comfort24-7 should be cancelled and
`
`whether any trademark right owned by Comfort24-7 provides a legitimate basis to support a
`
`finding of infringement. The determination of these issues by the District Court will likely be
`
`dispositive of the issues involved in this proceeding.
`
`Petitioner and Registrant therefore respectfully request suspension of these proceedings
`
`pending determination of the civil action pursuant to Trademark Rule 2.I1?(a), 37 C.F.R. §
`
`2.117(a). The Other Telephone Co. v. Connecticut National Telephone C0,, Inc, 181 USPQ 779
`
`(Comr. 1974); Whopper-Burger, Inc. v. Burger King Corp, 171 USPQ 805 (TTAB 197]). It is
`
`also the policy of the Board to suspend proceedings when the parties are also involved in a civil
`
`action that may be dispositive of or have a bearing on the case before the Board. See 37 C.F.R.
`
`§ 2.117(a); see also TBMP § 510.02(a) (3rd ed. rev. 2012).
`
`In this matter, 24:’? Home Comfort Services has filed a counterclaim asking the District
`
`Court to cancel the COMFORT24—? Trademark Registration on the basis that it is allegedly
`
`generic, merely descriptive, non-distinct and lacking secondary meaning, or is a combination of

`Michigan with Comfort24-7's l-IVAC Services and the use of the COMFORTZ4-7 Trademark

`substantially increases services rendered by Comfort24-7 through its website associated with the
`
`<comfort24-7.com> domain name.
