`Applicant-Petitioner hereby petitions to cancel Registrant-Respondent’s service
`
`mark Registration No. 3,320,341, pursuant to Trademark Rule 2.112(a). 37 C.F.R. §2.112(a).
`
`As grounds in support hereof, Applicant-Petitioner states as follows:

`Applicant-Petitioner will be damaged inasmuch as it has had the
`
`aforementioned registration cited against its pending applications to register the marks
`
`BARCLAYCARD ARRIVAL and ARRIVAL, Serial Nos. 85/690,496 and 85/690,514,
`
`respectively, in both cases for services in International Class 36, described as, “financial and
`
`banking services, namely, credit, credit card and charge card services featuring travel rewards.”

`On information and belief, Registrant-Respondent has made no use of the
`
`mark ARRIVA in connection with any services for at least three (3) consecutive years preceding
`
`the filing of this petition for cancellation, and Registrant-Respondent has no intent to resume
`
`such use.

`As a result of Registrant-Respondent’s protracted failure to use the
`
`ARRIVA mark and its lack of intent to resume such use, the ARRIVA mark that is the subject of
`
`Registration No. 3,320,391 has become abandoned for purposes of Section 45 of the Trademark
`
`Act. 15 U.S.C. § 1127.
`
`
`
`WHEREFORE, Applicant-Petitioner prays that its petition for cancellation be
`
`granted and that Registration No. 2,320,291 be ordered canceled forthwith.
