` Petitioner, Trek Bicycle Corporation (“Petitioner”), a

`Wisconsin corporation with its principal place of business at

`801 West Madison St., Waterloo, Wisconsin 53594, believes it is
`
`being damaged by the registration of the mark TREKKING KING for
`
`goods in Class 18 (“Registration No. 5,502,945”) and hereby
`
`petitions to cancel the same, in accordance with Section 14 of
`
`The Trademark (Lanham) Act of 1946, 15 U.S.C. §1064, or, in the
`
`alternative, for partial cancellation.
`
` As grounds for this Petition to Cancel, Petitioner alleges
`
`as follows:

`A. LIKELIHOOD OF CONFUSION
`
`1. Upon information and belief, Kamendatyan Hrayr
`
`(“Respondent”) is an individual and citizen of Armenia, located
`
`at 6 Sisakyan Str., Apt. 15, Yerevan, Armenia.
`
`2. Upon information and belief, Respondent owns
`
`Registration No. 5,502,945 for the mark TREKKING KING in
`
`connection with “Backpacks; Military duffle bags, garment bags
`for travel, tote bags, shoulder bags and backpacks” in Class 18
`(“Respondent’s Goods”).
`
`
`
`3. Upon information and belief, no party other than
`
`Respondent has an ownership interest in Registration No.
`
`5,502,945.
`
`4. Upon information and belief, Registration No. 5,502,945
`
`issued under Section 1(a) of the Trademark Act, and with claimed
`
`first use date and first use in commerce date of September,
`
`2017.
`
`
`
`5. For nearly 41 years prior to the claimed date of first
`
`use of the TREKKING KING mark, Petitioner adopted and has
`
`continuously used the trade name "TREK" in connection with its
`
`business activities.
`
`
`
`6. Petitioner has invested substantial amounts of time,
`
`effort and money in protecting and policing its TREK trade name
`
`in the United States and throughout the world. As such,
`

`Petitioner has extensive, non-registered statutory and common
`
`law rights in and to its TREK trade name, which Petitioner uses
`
`in connection with its business activities.
`
`
`
`7. For nearly 40 years prior to the claimed date of first
`
`use of the TREKKING KING mark, Petitioner adopted and has
`
`continuously used its TREK trademark in connection with bicycles
`
`and bicycle frames.
`
`8. Petitioner has expanded its trademark use of "TREK" to
`
`cover numerous additional products, including but not limited to
`
`backpacks, textile tote bags, all purpose sports bags; leather
`
`and imitation leather goods, namely, bags, stuff bags in the
`
`nature of carry-all bags, and luggage.
`
`9. Petitioner is the owner of the following U.S. trademark
`
`registrations:
`
`Registration No. 1,168,276 for TREK for "bicycles and
`bicycle frames" in Class 12 (see Exhibit A);
`
`Registration No. 1,989,281 for TREKKING for "bicycles" in
`Class 12 (see Exhibit B);
`
`Registration No. 1,994,479 for TREK 100 for "providing ride
`support vehicles in competitive and recreational events,
`namely, bicycle tours, bicycle races, and triathlons" in
`Class 39 (see Exhibit C);
`
`Registration No. 2,060,274 for TREK for "cycling computers
`and head protective helmets for bicycle users" in Class 9
`and “bicycles” in Class 12, among other goods (see Exhibit
`D);

`Registration No. 2,687,012 for ETREK for "online retail and
`wholesale store services, featuring a wide range of
`
`

`consumer products, except footwear, all provided via the
`Internet" in Class 35 (see Exhibit E);
`
`Registration No. 2,742,116 for TREK Stylized for "bicycles
`and bicycle frames" in Class 12 (see Exhibit F);

`Registration No. 2,745,442 for TREK for "bicycling apparel,
`namely, bicycling jersey; form fitting and reinforced seat
`elastic shorts; ankle length socks; wind resistant jackets
`with enhanced visibility fabric, extra sleeve length, high
`collar and extended length back panel; vests with enhanced
`visibility fabric, high collar and extended length back
`panel" in Class 25 and "padded and reinforced fingerless
`bicycling gloves" in Class 28 (see Exhibit G);

`Registration No. 2,876,977 for TREKLITE for "orienteering
`equipment and clothing for outdoor sporting activities,
`namely protective outer wear" in Class 9 and "orienteering
`equipment and clothing for outdoor sporting activities,
`namely, leggings, pants, gators, shirts, and jackets" in
`Class 25 (see Exhibit H);

`Registration No. 3,031,210 for TREK TRAVEL for "arranging
`travel tours featuring hiking, river rafting, whale
`watching, kayaking, and bicycling; cultural tours, namely,
`conducting sightseeing tours for others" in Class 39;
`"Sporting and cultural activities related to bicycling,
`namely, wine tastings and cultural tours, namely, guided
`tours of wineries” in Class 41; and "Services for providing
`food and drinks and temporary lodging for those
`participating in bicycling activities and cultural
`activities related to bicycling, namely, hiking, river
