`Applicant’s request for reconsideration is denied.   See 37 C.F.R. §2.63(b)(3).  The trademark
`examining attorney has carefully reviewed applicant’s request and determined the request did not:  (1)
`raise a new issue, (2) resolve all the outstanding issue(s), (3) provide any new or compelling evidence
`with regard to the outstanding issue(s), or (4) present analysis and arguments that were persuasive or
`shed new light on the outstanding issue(s).  TMEP §§715.03(a)(ii)(B), 715.04(a).

`Accordingly, the following requirement(s) and/or refusal(s) made final in the Office action dated May
`29, 2024 are maintained and continued:

`Specifically, in response to the FINAL Office Action dated  May 29, 2024, applicant responded with a
`Request for Reconsideration containing arguments
`that "other marks containing
`the word
`"NATIONAL" are registered on the Principal Register" without a disclaimer of NATIONAL or a 2(f)
`claim and that the evidence submitted by the trademark examining attorney is "insufficient" as the
`evidence "does not include any use of the term by the applicant, nor does the applicant's description of
`services make any reference" to the word NATIONAL. 
`
`In the present case, applicant’s request has not resolved all the outstanding issues, nor does it raise a
`new issue or provide any new or compelling evidence with regard to the outstanding issues in the final
`Office action. In addition, applicant’s analysis and arguments are not persuasive nor do they shed new
`light on the issues. 
`
`The term “national” has been held merely descriptive of services that are nationwide in scope. TMEP
`§1209.03(o); see, e.g., In re The Chamber of Commerce of the U.S., 675 F.3d 1297, 1301, 102 USPQ2d
`1217, 1220 (Fed. Cir. 2012) (holding NATIONAL CHAMBER merely descriptive of nationwide
`online directory services featuring information regarding local and state chambers of commerce and
`business and regulatory data analysis services for nationally promoting the interests of businesspersons
`or industry); In re Nat’l Rent A Fence, Inc., 220 USPQ 479, 479-80 (TTAB 1983) (holding

`NATIONAL RENT A FENCE merely descriptive of nationwide fence rental services); Nat’l Fid. Life
`Ins. v. Nat’l Ins. Trust, 199 USPQ 691, 694 (TTAB 1978) (holding NATIONAL INSURANCE TRUST
`merely descriptive of nationwide services of handling administrative matters in locating suitable
`insurance coverage for attorneys and other groups).
`
`Additionally, the previously submitted evidence clearly shows that the term NATIONAL means
`"competition that is national in scope" or "a competition in which participants compete for a nationwide
`ranking, title, championship" or "a contest or tournament involving participants from all parts of a
`nation." Please also see the newly attached evidence from  Dictionary.com, Cambridge Dictionary,
`and  Vocabulary.com,  which all further specify that NATIONAL refers to goods and/or services that are
`nationwide in scope or relating to a nation/country as a whole. Further, applicant's specimen of record
`and the attached evidence from  Pickleball Tournaments, which provides information about pickleball
`tournaments, including tournaments involving the applicant, occurring throughout the nation, and
`applicant's website, National Pickleball,  which shows that applicant promotes and organizes/arranges
`sports events around the nation, or on a national level, all indicate that applicant's Class 35 and Class 41
`services are provided nationally, or nationwide.  Please also see attached evidence from Virginia Tech,
`UVAToday, WQAD8, Oil City News, Forbes, Yes! Weekly, Fox 4, CBS Sports, Yahoo! Sports, USA
`Today, NCAA, National Sports Center, College Football Playoff, and  NFL,  which all show use of the
`term NATIONAL in a descriptive manner to describe pickleball and other sports competitions that are
`held nationwide or throughout the entire country.  Thus, the wording NATIONAL is merely descriptive
`of a feature of applicant's services.  The determination of whether a mark is merely descriptive is made
`in relation to an applicant’s goods and/or services, not in the abstract. DuoProSS Meditech Corp. v.
`Inviro Med. Devices, Ltd., 695 F.3d 1247, 1254, 103 USPQ2d 1753, 1757 (Fed. Cir. 2012); In re The
`Chamber of Commerce of the U.S., 675 F.3d 1297, 1300, 102 USPQ2d 1217, 1219 (Fed. Cir. 2012);
`TMEP §1209.01(b). “Whether consumers could guess what the product [or service] is from
`consideration of the mark alone is not the test.” In re Am. Greetings Corp., 226 USPQ 365, 366 (TTAB
`1985).  Here, the previously attached evidence and newly attached evidence and the specimen of record
`all show that the word NATIONAL is merely descriptive of the applicant's applied-for services. Thus,
`the wording must be disclaimed. 
`
`Applicant has also attached four registrations to argue that  a disclaimer of NATIONAL is not necessary
`because the attached registrations do not contain disclaimers of NATIONAL and do not contain a 2(f)
`claim. However, this argument is unpersuasive because Registration No. 6037035 and  Registration
`No. 3038666 contain unrelated services being various golf and resort services and  motion picture film
`and audio/video production services. Additionally, when determining whether an applied-for mark is
`eligible for registration, each application must be considered on its own record. In re Cordua Rests.,
`Inc., 823 F.3d 594, 600, 118 USPQ2d 1632, 1635 (Fed. Cir. 2016) (“[The Federal Circuit], like the
`Board, must evaluate the evidence in the present record to determine whether there is sufficient
`evidence . . . .”); In re Shinnecock Smoke Shop, 571 F.3d 1171, 1174, 91 USPQ2d 1218, 1221 (Fed.
`Cir. 2009) (“Applicant’s allegations regarding similar marks are irrelevant because each application
`must be considered on its own merits.”); see also In re Nett Designs, Inc., 236 F.3d 1339, 1342, 57
`USPQ2d 1564, 1566 (Fed. Cir. 2001) (“Even if some prior registrations had some characteristics
`similar to Nett Designs’ application, the PTO’s allowance of such prior registrations does not bind the
`[Trademark Trial and Appeal] Board or this court.”).  Additionally, the previously attached and newly
`attached third-party registrations demonstrate that NATIONAL is commonly disclaimed for the same
`and/or highly similar services to applicant's services.  
`
`Applicant argues that any doubt regarding the mark’s descriptiveness should be resolved on applicant’s
`behalf.  E.g., In re Merrill Lynch, Pierce, Fenner & Smith, Inc., 828 F.2d 1567, 1571, 4 USPQ2d 1141,
`
`

`1144 (Fed. Cir. 1987); In re Zuma Array Ltd., 2022 USPQ2d 736, at *8 (TTAB 2022) (quoting In re
`Fallon, 2020 USPQ2d 11249, at *8 (TTAB 2020)).  However, in the present case, the evidence of
`record leaves no doubt that the mark is merely descriptive.
`
`If applicant has already filed an appeal with the Trademark Trial and Appeal Board, the Board will
`be notified to resume the appeal.   See TMEP §715.04(a).  
`
`If applicant has not filed an appeal and time remains in the response period for the final Office
`action, applicant has the remainder of that time to (1) file another request for reconsideration that
`complies with and/or overcomes any outstanding final requirement(s) and/or refusal(s), and/or (2) file a
`notice of appeal to the Board.  TMEP §715.03(a)(ii)(B).

`The Dink Minor League Pickleball is team competition where teams of 4 players (2 women and 2 men) compete against
`eachother using the MLPlay”format:
`team matches are composedoffour 21-point games(rally scoring), one women's
`doubles, a men's doubles, and thefinal two gamesconsisting of mixed doubles.
`If both teamsare tied at 2-2 after the 4
`gamesare played, they'll go to a Dreambreaker™! In a Dreambreaker™ one person from each team plays singles against
`the other team’s player, switching players every fourrallies until someone gets to 21 and wins by two points.
