`CERTAIN DISCOVERY MATERIALS IN A PENDING ARBITRATION

`Plaintiff Seagen Inc. (“Seagen”) and Defendant Daiichi Sankyo Company, Limited
`
`(“Daiichi Sankyo Japan”) respectfully move pursuant to the Discovery Order (Dkt. 51 at § 12(b))
`
`and the Protective Order (Dkt. 55 at §§ 6, 8) for leave to permit Daiichi Sankyo Japan to use certain
`
`documents produced by Seagen in this action, and associated deposition testimony from this
`
`action, in a pending arbitration between Seagen and Daiichi Sankyo Japan.
`
`The Seagen-produced documents that Daiichi Sankyo Japan’s seeks leave to use in the
`

`The deposition transcripts Daiichi Sankyo Japan’s seeks leave to use in the arbitration are
`
`the November 12, 2021 deposition transcript of Scott Jeffrey and the November 17-18 deposition
`
`transcript of Peter Senter.
`
`Given that Seagen and Daiichi Sankyo Japan have reached an agreement permitting the
`
`use of the materials identified above, they respectfully request that the Court grant this joint
`
`motion. The parties also request that this joint motion be granted on an expedited basis, in light
`
`of upcoming deadlines in the arbitration. Further, because the filing of this joint motion resolves
`
`Daiichi Sankyo Japan’s pending February 2, 2022 motion for leave to use certain discovery (Dkt.
`
`No. 285), Daiichi Sankyo Japan will be withdrawing that motion.
`
