`In an effort to narrow disputes before the Court, Touchstream is considering an
`exchange with Comcast on Tuesday, September 17, of 35 proposed additions to the joint
`exhibit list from each party. We would like to extend the same offer to Charter.

`By our count there are 10 documents on both Charter and Touchstream's initial
`proposed lists, and we expect an additional 35 proposals will provide a good starting
`point to produce a combined list. Please let us know if such an exchange is agreeable to
