`Civil Action No. 3:22-cv-00410-B
`
`CLASS ACTION
`
`AGREED MOTION TO SET BRIEFING SCHEDULE FOR MOTIONS TO DISMISS
`THE FIRST AMENDED CONSOLIDATED CLASS ACTION COMPLAINT
`
`On November 14, 2024, Plaintiff Frank Moore (“Plaintiff”) filed the First Amended
`
`Consolidated Class Action Complaint for Violation of
`
`the Federal Securities Laws
`
`(“Complaint”). Doc. 131.
`
` Under Rule 12, Defendants’ deadline
`
`to respond
`
`to
`
`the
`
`Complaint is currently November 29, 2024. This is a securities class action with a 60-
`
`page Complaint and eleven Defendants1 represented by six firms.
`
`The parties have conferred and jointly request that the Court extend the deadlines for
`
`Defendants to respond to the Complaint and for subsequent briefing in the event Defendants move
`
`to dismiss. The parties desire to conserve resources in the near term while an ongoing mediation
`
`process proceeds with Hon. Royal Furgeson and David Murphy, Esq., and they also request the
`
`extension due to scheduling issues related to other matters and the upcoming holidays.
`
`1 “Defendants” are Brad K. Heppner, Peter T. Cangany, Jr., Thomas O. Hicks, Dennis P. Lockhart,
`Bruce W. Schnitzer, Murray T. Holland, Timothy L. Evans, David H. de Weese, Roy W. Bailey,
`David F. Chavenson, and The Beneficient Company Group, L.P.

`
`
`Plaintiff and Defendants therefore respectfully request that the Court enter the proposed
`
`order setting the following schedule for Defendants’ responses to the Complaint and briefing on
`
`any motions to dismiss:
`
`January 23, 2025 – deadline for Defendants to answer or move against the Complaint
`
`March 24, 2025 – deadline for Plaintiff to oppose if Defendants move to dismiss
`
`April 23, 2025 – deadline for Defendants’ reply(ies) in support of motions to dismiss
`
`Except as otherwise provided, the parties reserve their respective rights.
