`PERSONALLY APPEARED before me the undersigned authority this Affiant, who after being by me duly
`sworn, deposes and says your Affiant has good reason to believe and does believe that one, Richard
`Earl Cheney, hereinafter styled Defendant, heretofore, on or about the 26th day of June, 2015, in the
`County of Galveston and State of Texas did then and there unlawfully appropriate, by acquiring or
`otherwise exercising control over, property, to-wit: food and drink items, of the value of less than
`$1500, from HEB and/or Brian Nielson, the owner thereof, without the effective consent of the owner,
`and with intent to deprive the owner of the property.
`
`And it is further presented in and to said Court, that before the commission of the offense alleged
`above, the defendant had theretofore been twice convicted of theft in that on the 12th day of August,
`2013, in the County Court # 3 of Galveston, Texas, in cause number MD-0337613, the defendant was
`convicted of the offense of theft of property, and on the 3rd day of April, 2014, in the 10th District
`Court of Galveston, Texas, in cause number 13CR3557, the defendant was convicted of the offense of
`theft of property with two previous convictions.
