`IN THE NAME AND BY AUTHORITY OF THE STATE OF TEXAS:

`COMES NOW the undersigned Assistant County Attorney of Montgomery County,
`Texas, in behalf of the State of Texas, and presents in and to the County Court at Law of
`Montgomery County, Texas, that on or about MAY 9, 1999 in Montgomery County, Texas,
`MATTHEW KANE WEST, while operating a motor vehicle in a public place, was then and
`there intoxicated in that MATTHEW KANE WEST did not have the normal use of his
`mental and physical faculties by reason of the introduction of alcohol, a controlled
`substance, a drug, a dangerous drug, a combination of two or more of those substances,
`or any other substance into his body;
`
`It is further presented that on or about NOVEMBER 21, 1990, MATTHEW KANE
`WEST was convicted of the offense of DRIVING WHILE INTOXICATED in the County
`Court at Law of MONTGOMERY County, Texas, Cause Number 91762, said conviction
`becoming final prior to the commission of the aforesaid offense, and arising from an offense
`committed within ten years of the date of the commission of the offense alleged in the
`paragraph above,
