`COMES NOW THE STATE OF TEXAS, by and through her Assistant District Attorney in the
`above styled and notifies Defendant of the following:
`
`a.
`
`Technical Supervisor Glenn Merkord failed to conduct Acetone inspections of various
`instruments at the time they were taken out of service, a practice inconsistent with Texas
`Department of Public Safety [DPS] Standard Operating Guidelines. Those deviations from the
`Standard Operating Guidelines are contained within an Audit conducted by the Texas
`Department of Public Safety. The final audit findings are attached to this notice as Appendix
`A.
`
`Mr. J. Mack Cowan, Scientific Director for the Texas Department of Public Safety, suspended
`Mr. Merkord’s certification on May 10, 2013. The suspension was for a minimum of 30 days.
`The basis for the suspension was the wrongful reneWal of certification of eight Operators. A list
`of operators who were improperly renewed by Mr. Merkord is also contained within the DPS
`Audit which is attached in Appendix A. Originally the State was informed that two officers in
`Montgomery County were improperly re-certified but upon review of the final audit, only one
`Montgomery County officer is listed as being improperly re-certified by Mr. Merkord. There
`were a total of 48 operators improperly renewed in 2012; eight of those were renewed by Mr.
`Merkord. The letter suspending Mr. Merkord’s certification is attached as Appendix B. Mr.
`Merkord’s Performance Improvement Plan is attached as Appendix C.
`In addition to the recertification of operator matter, there was an issue with the calibration of an
`instrument in Trinity County. As Mr. Merkord was calibrating the instrument, the instrument
`had an interferent present that may have artificially increased a person’s breath test result by
`.005. This error was theoretically created when Mr. Merkord mixed a calibration formula
`which should not have, but apparently did, result in a carryover effect. The instrument detected
`the interferent, but it should not have been there. This was the only instance this problem was
`seen. This issue is contained within the DPS Audit in Appendix A.
`On July 22, 2011, Mr. Merkord noted that a new lamp was placed into Instrument # 68-00253 0.
`He did not note the exact date the lamp was changed.
`A defense attorney has alleged that there is documentation in the possession of the Texas
`Department of Public Safety that demonstrates Mr. Merkord’s testimony in a previous trial is
`mistaken or otherwise incorrect. Specifically, the attorney alleges that Mr. Merkord testified in
`that trial that he consistently or always performs acetone inspections of instruments when the
`instruments are placed into service, but he alleges that documentary evidence demonstrates this
`to be inaccurate. Additionally, the attorney claims that Mr. Merkord testified that he performed
`an acetone inspection on the instrument involved in that case, and that he did so when the
`instrument was placed into service on the same day it was taken out of service without an
`acetone inspection. The attorney alleges that there is documentary evidence demonstrating that

`Mr. Merkord did not do the acetone inspection of the particular instrument when it was placed
`into service on the day it was moved from one location to another. This allegation has not been
`confirmed.
`
`f.
`
`Prosecutors with the Montgomery County District Attorney’s Office met with Texas
`Department of Public Safety Director Mack Cowan and Deputy Director Randall Beaty on
`August 20, 2013. During this meeting the State learned that in 2009, DPS removed the spring
`valves in all of its instruments and replaced the spring valves with solenoid valves. Although ‘
`DPS determined that recalibration was not necessary to ensure the integrity of the instruments,
`out of an abundance of caution, DPS required that all instruments be recalibrated. Mr. Merkord
`failed to run a linearity test on an instrument in Polk County in 2009, resulting in the instrument
`not being certified for a period of time. The oversight was subsequently caught and resolved.
`g. The State learned from Technical Supervisor Ron Oliver that instrument # 68-012661 failed to
`subtract acetone on one out of three tests be conducted on July 17, 2013. Two tests were
`affected and the results of those tests should be subtracted by .006. _
`h. On October 21, 2013, the State spoke with Texas Department of Public Safety Deputy Director
`Randall Beaty and learned that Mr. Merkord failed to make adequate progress in his
`Performance Improvement Plan. Subsequently, he resigned voluntarily.

`i. On October 21, 2013, the State spoke with Texas Department ‘of Public Safety Deputy Director
`Randall Beaty and learned that after being placed on the Performance Improvement Plan, Mr.
`Merkord made a significant error in the calibration of an instrument. This error involved using
`an uncertified .400 solution during the recertitication of an instrument. On November 1, 2013,
`the State received the calibration file for that instrument. The instrument number is 68-001896.
`The calibration file shows that the error occurred on August 28, 2013. The calibration file is 42
`pages long and is available for copying in the defense attorney workroom in the Montgomery
`County District Attorney’s Office. The Texas Department of Public Safety informed the State
`that the calibration error was caught by the safeguards in place by the Texas Department of
`Public Safety prior to breath tests being run on this instrument. Subsequently, Mr. Merkord
`resigned voluntarily.
`

`During the Technical Supervisor certification suspension period, you will either report to the Conroe
`labomtory facility, the Houston laboratory facility or the Office of the Scientific Director in Austin
`depending upon the task assigned by management.

`While in Conroe, you will make preparations for the written and practical Technical Supervisor
`certification examination and perform other duties as assigned.
`

`While in Austin, you will complete remedial training by participating in selected portions of the Technical
`Supervisor training program. Selected training triples will include instrument design, function, operation,
`maintenance, and repair. Progress in these areas will be evaluated and additional topics may or may not
`be assigned.

`Without respect to the assignment, you will report to Regional Manager Spine by phone and email each
`Monday with a work plan outlining the upcoming week’s activities. Furthermore. a written summary of
`the activities completed the prior week will be provided to Regional Manager Spice and Deputy Scientific
`Director Beaty no later than the following Monday.

`Afier serving the conclusion ofthe 30 day suspension ofTechnical Supervisor certification, you will be
`required to take the written and practical examination. Independent Work Authorization to resume
`calibration activities will be contingent upon successful recertification as a Technical Supervisor.

`Upon successful completion ofthe Technical Supervisor certification exam and Independent Work
`Authorization, you will be required to:

`Perform Technical Supervisor/Forensic Scientist 1V duties as required by the Texas Department of
