`Before the Court is the Stipulation of Dismissal of Count I of the Complaint filed by

`Plaintiff Proven Networks, LLC (“Plaintiff”) and Defendant NetApp, Inc. (“Defendant”). The
`
`Court, having considered the Stipulation of Dismissal, finds that it is meritorious and that the
`
`relief requested should be granted.
`
`IT IS, THEREFORE, ORDERED that Count I of the Complaint be dismissed with
`
`prejudice, with each party to bear its own costs, expenses, and attorneys’ fees.
`
