`nonstatutory subject matter. Based on Supreme Court precedent, a method/process claim
`
`m ust (1) be tied to another statutory class of invention (such as a particular apparatus) (see
`
`at least Diamond v. Diehr, 450 U.S. 175, 184 (1981); Parker v. Flook, 437 U.S. 584, 588 n.9
`
`(1978); Gottschalk v. Benson, 409 U.S. 63, 70 (1972); Cochrane v. Deener, 94 U.S. 780,
`
`787-88 (1876)) or (2) transform underlying subject matter (such as an article or materials) to
`
`a different state or thing (see at least Gottschalk v. Benson, 409 U.S. 63, 71 (1972)). A
`
`method/process claim that fails to meet one of the above requirements is not in compliance
`
`with the statutory requirements of 35 U.S.C. 101 for patent eligible subject matter. Here
`
`claims 1-4 fail to meet the above requirements because the claims fail to tie in another
`
`statutory class of invention.
`
`3. Claims 1-7 are rejected under 35 U.S.C. 101 because the claimed invention lacks
`
`patentable utility. The invention product is "storing the association" of a digital media asset
`
`with its attribute. This provides neither specific nor substantial utility (MPEP § 2107.01).
`
`Claim Rejections - 35 USC § 102
`
`4. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the
`
`basis for the rejections under this section made in this Office action:
`
`A person shall be entitled to a patent unless —
`
`(b) the invention was patented or described in a printed publication in this or a foreign country or in
`public use or on sale in this country, more than one year prior to the date of application for patent in
`the United States.
`
`5. Claims 1-7 are rejected under 35 U.S.C. 102(b) as being anticipated by Dedrick
`
`(U5005754787A).

`6. Dedrick teaches (independent claims 1 and 4) a method and system of associating
`
`attributes with digital media assets (col. 1 lines 38-42), the method comprising:
`
`identifying a digital media asset (digital audio);
`
`associating at least one digital media asset attribute with the digital media asset as an
`
`association (as well as associated labels and attributes); and
`
`storing the association of the digital media asset with the at least one digital media asset
`
`attribute (inherently because Dedrick teaches that the asset is distributed with its attribute).
`
`7. Claim scope is not limited by claim language that suggests or makes optional but does not
`
`require steps to be performed, or by claim language that does not limit a claim to a particular
`
`structure (MPEP § 2111.04). Accordingly, no patentable weight was given to the following
`
`claim language:
`
`"wherein the at least one digital media asset attribute is classified according to at least
`
`one of significance of affinity, self narrating audience generated content classification,
`
`defined topologies, time sensitive sequencing, and collective/collaborative classification".
`
`8. Dedrick also teaches claims 2 and 6 at the citation given above.
`
`9. Note on interpretation of claim terms - Unless a term is given a "clear definition" in the
`
`specification (MPEP § 2111.01), the examiner is obligated to give claims their broadest
`
`reasonable interpretation, in light of the specification, and consistent with the interpretation
`
`that those skilled in the art would reach (MPEP § 2111). An inventor may define specific
`
`terms used to describe invention, but must do so "with reasonable clarity, deliberateness,
`
`and precision" (MPEP § 2111.01.111). A "clear definition" must establish the metes and
`
`bounds of the terms. A clear definition must unambiguously establish what is and what is
`
`not included. A clear definition is indicated by a section labeled definitions, or by the use of
`
`phrases such as "by xxx we mean"; "xxx is defined as"; or "xxx includes, ... but does not
`
`include ...". An example does not constitute a "clear definition" beyond the scope of the
`
`example.
`
`10. The instant application contains no such clear definition for the phrase "digital media asset".
`
`I n the instant case, the examiner is required to give the term "digital media asset" its
`
`broadest reasonable interpretation, which the examiner judges to be any content on or in
`
