`Google respectfully requests that this Court
`
`issue a writ of
`
`mandamusto the United States District Court for the Western District
`
`of Texas (WDTX) vacating the district court’s order denying Google’s
`
`motion to transfer and directingthedistrict court to transfer this case to
`
`the Northern District of California (NDCA).
`
`INTRODUCTION
`
`The district court denied Google’s motion to transfer this case to
`
`NDCA on grounds that squarely contravene this Court’s decisions.
`
`NDCAhasa strong connection to and interest in this litigation, while
`
`WDTX hasvirtually no connection beyondtheplaintiffs decision to bring
`
`suit there. Plaintiff Flypsi, Inc., (“Flyp”) is a Delaware company with an
`
`WDTX. Yet Flyp brought this suit in WDTX, accusing the Google Voice
`
`product of infringing certain patents. Google Voice was primarily
`
`developed at Google’s NDCA headquarters by Google employees. NDCA
`
`thus is more convenient for the overwhelming majority of willing
`
`witnesses with relevant information, while the few Google employees in
`
`WDTX have knowledge that is at best duplicative of that of Google’s

`
`many NDCA employees. NDCA can compel the attendance of the large
`
`majority of third-party witnesses, as 16 prior-art witnesses and a
`
`prosecution attorney with knowledge critical to Google’s inequitable-

`e Willing witnesses. Although six key witnesses are located in or
`around NDCA, while only two individuals with questionably
`relevant knowledge are in or near WDTX,the district court found
`this factor neutral by improperly weighing Flyp’s employees in
`NDTX (not WDTX) against
`transfer—even though there is
`concededly no evidence that those employees possess any “specific
`knowledge ... that would be needed in this case.” Appx0013. The
`court thus abandonedits obligation to assess “the relevance and
`materiality of’? the witnesses’ knowledge before weighing them
`against transfer. In re Juniper Networks, Inc., No. 21-156, 2021 WL

`
`In nonetheless refusing to transfer the cases, the district court
`
`disregardedthis Court’s transfer decisions and consistently weighed even
`
`the most tenuous connections to Texas against transfer—at times going
`
`so far as to advance speculative arguments that Flyp itself had not. With
`
`respect to nearly every conveniencefactor, the district court ignored clear
`
`contrary precedent:
`
`e Compulsory process. Despite the presence of 17 concededly
`relevant third-party witnesses in NDCA,the district court gave
