`Petitioners Farmworker Association of Florida, et.al, provide this response to
`Intervenor AgLogic’s Rule 28(j) letter concerning the Florida Department of
`Agriculture and Consumer Services Notice of Denial of AgLogic’s applications for
`registration of use of aldicarb products on citrus. AgLogic intends to challenge the
`denial; therefore, the denial is not final.
`
`Petitioners’ request for a stay of the Environmental Protection Agency’s (EPA)
`registration decisions is not premature. If AgLogic prevails in its state challenge,
`without a stay from this Court, AgLogic may immediately sell aldicarb products
`for use on citrus in Florida. Once sold, EPA allows use of what it refers to as
`“existing stocks” even if a Court vacates the registrations prior to the season of use.
`
`Petitioners will further support these statements in its replies to AgLogic and
`EPA’s oppositions to Petitioners’ Motion for Stay.
