`Defendants-Appellants’ opening briefs are currently due on December 22, 2025.
`ECF No. 25. No party has previously requested an extension of time for this filing.2
`On December 5, 2025, Thomas M. Beline, counsel for Plaintiffs-Appellees Auxin
`Solar Inc. and Concept Clean Energy, Inc., consented by email to Intervenor
`Defendants-Appellants’ motion for an extension of time to file their opening brief.
`Douglas G. Edelschick, counsel for Defendants-Appellants United States, et al .,
`consented to this request for an extension by email on December 5, 2025, and also
`requested that any such extension be applied to the opening briefs for all Defendants-
`Appellants to maintain the order of briefing and the efficient progress of the appeal.
`There is good cause to grant this extension for at least two reasons –
`(1) Intervenor Defendants-Appellants require more time to coordinate preparation of
`their single, joint opening brief, and (2) Intervenor Defendants-Appellants require
`additional time in light of intervening holidays and other professional commitments.
`First, Intervenor Defendants-Appellants require additional time to coordinate
`the preparation of a single, joint opening brief. Intervenor Defendants-Appellants
`consist of 29 different entities, represented by several different law firms and serving

`distinct roles within the global solar industry ( e.g., energy industry associations,
`domestic and foreign solar manufacturers, and U.S. solar customers). The counsel
`representing these diverse perspectives are currently working to prepare a single, joint
`opening brief, which they hope will facilitate this Court’s ability to decide this matter
`efficiently. The substantial number of separate counsel and stakeholders involved in
`preparing this single, joint brief necessitates additional time to allow for the continued
`coordination and preparation of unified argument.
`Second, counsel for Intervenor Defendants-Appellants require additional time
`to complete the single, joint opening brief due to intervening holiday commitments
`and conflicting professional obligations. In particular, counsel and their offices
`recently observed the U.S. Thanksgiving holiday, and they will additionally be
`impacted by the December and New Year holiday season. Moreover, as detailed in
`the attached declaration, undersigned counsel must contend with several significant,
`competing deadlines in the period surrounding this filing, further necessitating
`additional time to ensure that Intervenor Defendants-Appellants’ joint brief is as
`helpful as possible for this Court.
`Finally, to ensure that the briefing deadlines in this appeal continue to align,
`Intervenor Defendants-Appellants request that any extension granted by this Court
`apply to all Defendants-Appellants, including the Government parties. Accordingly,
`Intervenor Defendants-Appellants respectfully request that the Court grant a 50-day

`1. I am a partner and the co-practice leader of the International Trade and
`Investment group at Hogan Lovells US LLP. In this capacity, I am counsel of record
`for Defendant-Appellant Canadian Solar in the above-captioned case. I am also
`involved in coordinating Intervenor Defendants-Appellants’ efforts to file a joint
`opening brief in this appeal.
`2. Good cause exists for the requested extension of time to file Intervenor
`Defendants-Appellants’ opening brief. Intervenor Defendants-Appellants consist of
`29 entities, representing diverse voices within the global solar power industry, from
`domestic and foreign solar manufacturers to U.S. solar customers to energy industry
`associations.
`3. Intervenor Defendants-Appellants are currently working to prepare a
`joint opening brief. The large number of stakeholders involved necessitates
`additional time for coordination and the preparation of our strongest arguments on
`appeal. This is particularly the case because counsel and their offices observe the
`Thanksgiving, December, and New Year holidays in the United States.
`4. In addition, although pressing demands in other proceedings are not
`necessarily cause for an extension here, counsel for Defendant-Appellant Canadian
`Solar calls to this Court’s attention that additional time is needed to complete
`coordination and preparation of the opening brief due to responsibilities in numerous
`ongoing proceedings before this Court, the Court of International Trade, and

`administrative agencies. For example, counsel for Canadian Solar is also counsel of
`record in the following, among many active proceedings: (1) the ongoing
`antidumping duty (“AD”) and countervailing duty (“CVD”) investigations on
`Silicon Metal from Australia before the U.S. Department of Commerce
`(“Commerce”), in Case Nos. A-602-813 (AD) and C-602-814 (CVD); (2) the
`ongoing final injury investigations concerning Silicon Metal from Angola, Australia,
`Laos, Norway, and Thailand , Inv. Nos. 701-TA-760-763 and 731-TA-1743-1746,
`before the U.S. International Trade Commission (“USITC”), which has scheduled
`hearing and briefing dates in January 2026; (3) a companion case to the instant
`appeal, Trina Solar Science & Technology (Thailand) Ltd. v. US , Ct. No. 25-1940,
`which currently has a February deadline for reply briefs; and (4) appeals of the AD
`and CVD investigations concerning Crystalline Silicon Photovoltaic Cells, Whether
`or Not Assembled into Modules, from Thailand before the U.S. Court of International
`Trade, in Ct. Nos. 25-00159 (Commerce AD), 25-00161 (Commerce CVD), and
`25-00163 (USITC). Undersigned counsel likewise represents many U.S. importer
`and domestic producer clients that have other regulatory and court obligations during
`this same period. Moreover, I am scheduled to be on business travel the week
`preceding the current December 22, 2025 deadline.
`5. I additionally understand that the various other law firms representing
`other Defendants-Appellants in this proceeding are similarly contending with
