`SECOND JOINT NOTICE REGARDING
`INTER PARTES REVIEW PROCEEDINGS
`
`Plaintiff SoundClear Technologies, LLC (“SoundClear”) and Defendant Google LLC
`(“Google”) (collectively “the Parties”) submit this joint notice pursuant to the Court’s March 31,
`2025 order (Dkt. 84).
`[SoundClear’s Position] All proceedings have finally concluded in connection with
`Google’s IPR Petitions. On August 4, 2025, the United States Patent and Trademark Office
`(“USPTO”) discretionarily denied the petitions for inter partes review filed by Google and did
`not institute trial with respect to U.S. Patent Nos. 9,070,374 (IPR2025-00344) and 9,031,259
`(IPR2025-00345). See IPR2025-00344, Paper 15; IPR2025-00345, Paper 15. On November 3,
`2025, the Director denied Google’s request for director review. See IPR2025-00344, Paper 18;
`IPR2025-00345, Paper 18.
`SoundClear respectfully requests that this Court therefore lift its stay (Dkt. 84) and
`proceed with this case. Google previously contested lifting the stay on the basis that it had the
`right to request a director rehearing. Google filed its request on September 3, 2025. The Director
`denied that request on November 3, 2025.

`Each of the Asserted Patents was subject to parallel IPR petitions filed by Amazon. See
`IPR2025-01096 (challenging all claims of the ’259 Patent), IPR2025-01067 (challenging all
`claims of the ’374 Patent), and IPR2025-01080 (challenging all but one dependent claim of the
`9,804,819 Patent). The USPTO discretionarily denied each of Amazon’s petitions. Amazon has
`the right to file a request for a director rehearing by November 17, 2025. The likelihood of any
`such request being granted is low because the Director’s reasons for discretionarily denying
`Amazon’s petitions (e.g., “Patent Owner’s strong settled expectations”) are substantially the
`same as the reasons for the Director’s discretionary denial (and subsequent affirmation of that
`denial) of the Google’s petitions. Compare, e.g., IPR2025-01067, Paper 15 at 2-3 with IPR2025-
`00344, Paper 15 at 2-3. SoundClear requests that this Court set a date for a hearing to set a case
`schedule. If Amazon files a request for director review and it is granted, SoundClear will agree to
`reinstitute the stay until it is resolved.
`[Google’s Position] Google disagrees that the stay should be lifted at this time.
`As to Amazon’s IPR Petitions, as noted by SoundClear, Amazon has a right to a request
`director rehearing on the USPTO’s discretionary denial of IPR2025-01096 (challenging all
`claims of the ’259 Patent), IPR2025-01067 (challenging all claims of the ’374 Patent), and
`IPR2025-01080 (challenging all but one dependent claim of the 9,804,819 Patent). If Amazon
`requests director rehearing and the USPTO grants that request, the question of the validity of the
`patents in suit will remain with the USPTO through 2026. Therefore, lifting the stay now, before
`the USPTO has decided if the IPR petition process may continue, would be an inefficient use of
`the Court’s and parties’ resources. Accordingly, it is not appropriate to lift the stay at this time.
`Amazon must request director rehearing by November 17, 2025.

`As to Google’s IPR Petitions, Google is presently considering its options to challenge the
`director review denials. See IPR2025-00344, Paper 18; IPR2025-00345, Paper 18.
`Finally, even if the Court were inclined to lift the stay, no hearing to set a case schedule is
`needed at this time. Google has filed two motions: (1) a motion to dismiss for failure to state a
`claim under Rule 12(b)(6), seeking dismissal of the claims related to the ’374 and ’819 patents,
`as well as all claims for willful infringement, ECF No. 13, and (2) a motion to transfer to the
`Northern District of California under 28 U.S.C. § 1404(a), ECF No. 38. Both motions are ripe
`and remain pending. ECF No. 84 at 2.
